ATTACHMENT 1 <br /> FOURTH AMENDMENT TO AGREEMENT FOR CONSULTING SERVICES <br /> This Fourth Amendment for consultant services, is entered into this day of <br /> , 2014, by the City of Pleasanton ("City") and Crowe Horwath LLP, a limited <br /> liability partnership, duly qualified to conduct business in the State of California, whose principal <br /> place of business is 400 Capitol Mall, Suite 1200, Sacramento, CA 958144434; (hereinafter <br /> referred to as"Contractor"); <br /> RECITALS <br /> WHEREAS, NewPoint Group, Inc., has been engaged by the City under Agreement No. 12-876C <br /> to provide solid waste rate review and rate setting assistance in accordance with Agreement No. 12- <br /> 876C, dated March 6,2012; and <br /> WHEREAS, in 2013 the City approved an assignment of the Agreement to Crowe Horwath LLP; <br /> and <br /> WHEREAS, the parties hereto have mutually agreed to an amended scope of work detailed in <br /> Exhibit A to this Amendment, related to the Pleasanton Garbage Service, Inc. Schedule of <br /> Annual Revenue and Expenses Applicable for Rate Setting Purposes For the Base Year 2014 and <br /> Projected Period 2015 dated August 1, 2014; and <br /> WHEREAS, the parties hereto have mutually agreed to increase funding by a maximum of <br /> $34,700 for the scope of services included in Exhibit A of the Agreement; and <br /> NOW THEREFORE, the parties agree to amend the Agreement on the following terms and <br /> conditions: <br /> 3. Terms. This contract shall expire on June 30, 2015. <br /> 4. Compensation. Contractor shall perform the additional rate setting work identified in <br /> Exhibit A to this Fourth Amendment to the Agreement on a time and material basis with a <br /> maximum contract amount of $34,700. The payments shall be made on a monthly basis upon <br /> receipt and approval of Consultant's invoice. Contractor shall bill for services at the following <br /> hourly rates: <br /> Principal $180 per hour <br /> Senior Manager $165 per hour <br /> Senior Consultant $145 per hour <br /> Consultant $110 per hour <br /> 13. Notices. All notices herein required shall be in writing and shall be sent by certified or <br /> registered mail, postage prepaid, addressed as follows: <br /> -1- <br />
