BACKGROUND <br /> On March 3, 2009, the City Council approved a residential development with 110 single- <br /> family homes known as the Ironwood Active Adult Community or Village at Ironwood. <br /> As a condition of approval, the developer, Ponderosa Homes was required to construct <br /> a public trail adjacent to the development on property located between the southern <br /> boundary of Lake I and the northern boundary of the Village at Ironwood. Portions of <br /> the public trail are located within the Mohr Avenue right of way owned by the City. <br /> Other portions of the public trail are located on property owned by Zone 7, thus, the City <br /> needs a License Agreement from Zone 7 to place the trail on Zone 7 property in <br /> exchange for the City agreeing to maintain the trail. Last July, the Council approved a <br /> First Amendment to the License Agreement to include this public trail. Since that time, <br /> City staff has received requests from a few property owners within the Village at <br /> Ironwood to move the trail north and farther away from their properties. This Second <br /> Amendment to the License Agreement accomplishes this by moving portions of the trail <br /> north and closer to Lake I. <br /> Also in July of 2013, the Council approved a License Agreement related to the storm <br /> drain system discussed above. Zone 7 never executed that agreement and staff from <br /> the City and Zone 7 have worked together to prepare a new agreement (Maintenance <br /> Agreement) that will set forth the obligations of both parties with regard to maintenance. <br /> The City will be responsible for routine preventative maintenance of the system while <br /> Zone 7 will be responsible for minor and major repairs. <br /> DISCUSSION <br /> Ponderosa Homes has completed grading work for the trail and will complete the <br /> remaining work including fencing, gates, landscaping etc. before final acceptance of the <br /> subdivisions within "The Village at Ironwood." Once completed, residents of the <br /> Ironwood Active Adult Community will have trail access to and from Mohr Avenue. The <br /> trail will be open to the public but the trail will "dead end" at the east end of the Village at <br /> Ironwood until such time as it may be extended east as part of the East Pleasanton <br /> Specific Plan. The Second Amendment to License Agreement allows the trail to be <br /> constructed on Zone 7 property.
