granted the rights and remedies of the association, but not the obligation, to <br /> enforce the maintenance responsibilities of the property owners association. <br /> 45. The project developer shall show with the tentative subdivision map application <br /> the building setback lines conditioned by this approval superimposed on the lots. <br /> 46. The CC&R's for the project shall prohibit the parking of boats, campers, and <br /> trailers on Lots 1 through 8. <br /> 47. Prior to recordation of the final subdivision map, all modifications required to the <br /> design guidelines through conditions of approval shall be combined into a single <br /> comprehensive document. This document shall be submitted to the Planning <br /> Director for review and approval prior to publication. The project developer or its <br /> successor in interest shall disclose the design guidelines to the lot buyers prior to <br /> close of escrow, and shall provide them with copies of the guidelines. <br /> 48. The project developer shall prepare maintenance agreements for the shared <br /> driveway including the culverts/bridges. The agreements shall be submitted to <br /> the City Attorney for review and approval before City Council approval of the first <br /> final subdivision map for this development and shall be recorded over the project <br /> site by separate instrument. <br /> 49. The recorded deed of sale for all lots covered by this PUD Development Plan <br /> approval shall include the following: <br /> a. A disclosure stating that the City of Pleasanton intends to develop and <br /> operate the Alviso Adobe Park, a City park, and that the buyer recognizes <br /> that the activities that take place in the Alviso Adobe Park may result in <br /> noise, odors, dust, traffic or other conditions that may affect the lots <br /> covered by this PUD Development Plan. <br /> b. A disclosure stating that the City of Pleasanton owns the open space area <br /> surrounding Lots 1 through 8, that the open space area can be used by <br /> the public, that the open space area may include a trail which would <br /> connect to the Pleasanton Ridge trail, and that the buyer recognizes that <br /> the activities that take place in the open space area may result in noise, <br /> odors, dust, or other conditions that may affect the lots covered by this <br /> PUD Development Plan. <br /> c. A disclosure indicating the presence of the subdrains and cleanouts and <br /> that it is the responsibility of the homeowner to relocate the subdrains if <br /> encountered during the excavation of a pool or other subsurface structure. <br /> d. The following statement, signed by the future homeowner stating, that: <br /> 12 <br />
