ORDINANCE NO. 1942 <br /> AN ORDINANCE APPROVING THE APPLICATION OF CHARLES AUSTIN AND <br /> SCOTT AUSTIN FOR PUD REZONING AND DEVELOPMENT PLAN APPROVAL, <br /> AS FILED UNDER CASE PUD-58 <br /> WHEREAS, Charles Austin and Scott Austin have applied for PUD rezoning and <br /> development plan approval to rezone an approximately 30-acre hill property located at <br /> 3459 Old Foothill Road from A (Agriculture) District to PUD-LDR (Planned Unit <br /> Development — Low Density Residential) District, maximum of eight dwelling units, on <br /> eight acres and to PUD-OS/AG (Planned Unit Development — Open Space/Agriculture <br /> and Grazing) Districts on the remaining 22 acres, and to subdivide the subject property <br /> into eight custom home sites and 22 acres of permanent open space; and <br /> WHEREAS, based on the Initial Environmental Study, a Negative Declaration <br /> was adopted by the City Council on October 17, 2006; and <br /> WHEREAS, at its meeting of October 17, 2006, the City Council received the <br /> Planning Commission's positive recommendations for approval of the PUD rezoning <br /> and development plan; and <br /> WHEREAS, a duly noticed public hearing was held on October 17,2006; and <br /> WHEREAS, after a review of the materials presented, the City Council <br /> determined that the proposed rezoning is appropriate for the site; and <br /> WHEREAS, the City Council finds that the proposed PUD rezoning and <br /> development plan are consistent with the General Plan policies of the City of <br /> Pleasanton and the purposes of the PUD ordinance. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> HEREBY ORDAIN AS FOLLOWS: <br /> Section 1. Approves the rezoning of an approximately 30-acre hill property located at <br /> 3459 Old Foothill Road from A (Agriculture) District to PUD-LDR (Planned Unit <br /> Development — Low Density Residential) District on eight acres and to PUD-OS/AG <br /> (Planned Unit Development — Open Space/Agriculture and Grazing) Districts on the <br /> remaining 22 acres, as shown on the attached Exhibit C, dated October 17, 2006, and <br /> incorporated herein by this reference. <br /> Section 2. The Zoning Map of the City of Pleasanton, dated April 18, 1960, on file <br /> with the City Clerk, designating and dividing the City into zoning districts, is hereby <br /> amended by Zoning Unit Map No. 466, attached hereto as Exhibit A, dated October 17, <br /> 2006, and incorporated herein by this reference. <br />
