Mr. Hirst reported that all neighbors were notified prior to the Planning Commission hearing, where the <br /> item received no negative feedback and was passed as part of the Consent Calendar. <br /> Mayor Thome closed the public hearing. <br /> Councilmember Narum asked if moving forward presented any legal risk to the city. <br /> Mr. Lowell said "no." He explained that the failure to send a mailed notice is generally not cause to set <br /> aside a matter and that the item was placed on the Agenda, which was properly posted and published. <br /> He advised that this is really more of a political policy question for the Council to consider. <br /> MOTION: It was m/s by Pentin/Thorne to waive first reading and introduce Ordinance No. 2105 <br /> approving a Development Agreement with Charels, Scott & Ian Austin to vest the development <br /> approvals of the Austin project (PUD-58 and Tentative Tract 7813) consisting of eight (8) single-family <br /> residential lots and 22 acres of permanent open space at 3459 Old Foothill Road for a ten-year period <br /> from 2014 to 2024 with a five-year option. Additional direction was given to staff regarding issuing and <br /> confirming receipt of a public notice of the Ordinances second reading. In addition, the item will be <br /> placed on the regular agenda. Motion carried by the following vote: <br /> AYES: Councilmembers Cook-Kallio, Narum, Pentin, Mayor Thorne <br /> NOES: Councilmember Brown <br /> ABSENT: Councilmember Cook-Kallio <br /> 22. 2014 State Legislative Initiatives <br /> Maria Ojeda, Assistant to the City Manager, presented a brief overview of the 2014 State Legislative <br /> Summary and recommendations, as developed by the Council's Legislative Subcommittee. <br /> Bills to Support <br /> • AB 1147 — Relates to massage therapy; returns land use, zoning and business regulation <br /> authority to local governments. <br /> • SB 1262 — Relates to medical marijuana; returns the primary responsibility for regulation of <br /> dispensaries to local governments. <br /> • SB 33— Relates to post-redevelopment agency options for infrastructure financing districts. <br /> Bills to Oppose <br /> • AB 2188— Relates to solar energy permits; requires the approval of a 10 kilowatt or less project <br /> to be expedited and subject to only inspection. The bill seems somewhat incomplete in terms of <br /> defining "timely" and is unvetted with respects to the protection of local control. <br /> • AB 2052 — Relates to Workers' Compensation; expands benefits for all peace officer <br /> classifications, which may include a broader group of employees than currently have benefits in <br /> place through the state. <br /> • AB 2378 — Relates to Workers' Compensation; extends temporary disability benefits by one <br /> year at two-thirds salary which results in increased costs to local government. <br /> Ms. Ojeda stated that the Legislature has adjourned for Summer Recess and will reconvene on August <br /> 4, 2014.
