BACKGROUND <br /> On April 17, 2012, the Planning Commission recommended City Council approve an <br /> application by BRE Properties, Inc. for a mixed use high-density residential/commercial <br /> development at the southeast corner of Owens Drive and Willow Road (see Attachment <br /> 1). <br /> On May 1, 2012, the City Council approved PUD-85-08-12D, to construct a mixed use <br /> high-density residential/commercial development containing 251 residential apartment <br /> units, four live and work units, and approximately 5,700 square feet of retail space. The <br /> property is an 8.4 acres parcel located at the southeast corner of Owens Drive and <br /> Willow Road. <br /> The Engineering staff, Planning staff, and the City Attorney's Office and Hacienda <br /> Business Park Association have reviewed the request for exchange of rights of way and <br /> easements and have found them in substantial conformance. The developer has <br /> submitted the necessary bonds for offsite improvements, paid City inspection fees for <br /> public improvements, and signed and submitted an Offsite Improvement Agreement. <br /> DISCUSSION <br /> The project will construct a median strip and diagonal parking on the south side of <br /> Owens Drive. The existing bus stop on the south side of Owens Drive will also be <br /> relocated to accommodate the angled parking. The project will reconstruct curb along <br /> the east side of Willow Avenue for parking stall and bus pull out areas. Both of the <br /> above mentioned revisions, as shown on the attached exhibits, require exchanging of <br /> rights of way and easements to keep the back of curb as the right of way line. Simply <br /> stated, the rights of way and easements are being adjusted so that all sidewalk and <br /> landscape areas will be located on private property and maintained by Essex, and all <br /> the street surface will be in the public right of way and maintained by the City. <br /> The project will also install charging stations for charging electric vehicles along the <br /> south side of Owens Drive near the diagonal parking. Additionally, the project will install <br /> an on-site paved trail and landscaping along the east side of the project boundary <br /> (which is also the west property line of Kaiser Foundation Hospital); install median strip <br /> landscaping between the diagonal parking on the south side of Owens Drive and public <br /> traffic on Owens Drive; restripe Owens Drive and Willow Drive to accommodate bike <br /> lane on each side of the street; and construct a left turn pocket for turning left into the <br /> project site from southbound Willow Avenue. <br /> Page 2 of 3 <br />
