THE CITY OF <br /> ® - w � '�' CITY COUNCIL AGENDA REPORT V <br /> PL£ASANTONe <br /> July 15, 2014 <br /> Community Development <br /> Engineering Division <br /> TITLE: APPROVE A RESOLUTION AUTHORIZING THE QUITCLAIM OF RIGHTS <br /> OF WAY AND PUBLIC SERVICE EASEMENTS AND THE ACCEPTANCE <br /> OF RIGHTS OF WAY AND PUBLIC SERVICE EASEMENTS AT THE <br /> ESSEX-OWENS SITE (FORMERLY BRE 1) <br /> SUMMARY <br /> Essex has acquired the property located at the southeast corner of Owens Drive and <br /> Willow Road (formerly known as BRE-I site) which has PUD approval to construct <br /> mixed use high-density residential and commercial development. After preparing <br /> detailed construction plans for the onsite and offsite improvements, the developer has <br /> requested that the City quitclaim certain rights of way and easements and dedicate <br /> certain rights of way and easements for ease of operation and maintenance <br /> responsibilities, and to ensure the street right of way is entirely beyond the curb. Staff <br /> and Hacienda Business Park Association have reviewed the improvement plans and <br /> exchange of rights of way and easements and have found them to be in substantial <br /> conformance with the PUD approval. <br /> PLANNING COMMISSION RECOMMENDATION <br /> On April 17, 2012, the Planning Commission approved an application by BRE <br /> Properties, Inc. for a Planned Unit Development to construct a mixed use high-density <br /> residential/commercial development containing 251 residential apartment units, four live <br /> and work units, and approximately 5,700 square feet of retail space. The property is on <br /> an 8.4 acres parcel located at the southeast corner of Owens Drive and Willow Road. <br /> RECOMMENDATION <br /> 1. Approve a resolution authorizing the quitclaim of rights of way and public service <br /> easements at the ESSEX site at southeast corner of Owens Drive and Willow Road. <br /> 2. Authorize the City Manager to execute necessary documents for granting street <br /> rights of way within the quitclaimed area. <br /> 3. Accept all parcels of land and easements offered for dedication at locations shown <br /> on the attached exhibit and dedicated to the City by separate instrument. <br /> FINANCIAL STATEMENT <br /> There will not be increase in an annual operating budget when rights of way and <br /> easements are exchanged with ESSEX property owners. <br />
