The cost of ESA's services is to be paid by Nearon Enterprises, an owner of 24 acres <br /> within the proposed Johnson Drive Economic Development Zone. At the Council's April <br /> 15, 2014 meeting, Council concurred that "...property owner(s) within the economic <br /> development zone will be asked to underwrite the cost of the environmental review <br /> through agreement with the City." A Reimbursement Agreement (Attachment 2) has <br /> been prepared that provides for Nearon Enterprises to reimburse the City for the cost of <br /> ESA's services. Section 3 of the proposed reimbursement agreement provides that as <br /> other property owners within the zone develop, those other property owners will <br /> reimburse Nearon Enterprises pro rata shares of these costs. <br /> In conclusion, staff recommends that the City Council approve both a Professional <br /> Services Agreement with ESA, as well as a Reimbursement Agreement with Nearon <br /> Enterprises, subject to minor modifications approved by the City Manager and City <br /> Attorney, and authorize the City Manager to execute the same. <br /> Submitted by: Approved by: <br /> ri4,11/4.-titkrev <br /> Brian Dolan Emily Wagner Nelson Fialho <br /> Director of Community Director of Finance City Manager <br /> Development <br /> Attachments: <br /> 1.
