Fifth Amendment to the Professional Services Agreement with BKF Engineers: <br /> In September 2010, City Council approved a Professional Services Agreement with <br /> BKF Engineers to prepare plans, specifications and estimates (PS&E) and <br /> environmental documentation for the Bemal Avenue at 1-680 Improvement Project. <br /> During design, Caltrans indicated that the 1-680/Bernal Avenue interchange was within <br /> an area that has been identified as archaeologically sensitive.. As a result, a Historic <br /> Compliance Report outlining a testing and monitoring program is necessary and must <br /> be submitted to Caltrans and the State Historic Preservation Office (SHPO). Preparing <br /> this report is additional work that was not included in the original scope of services. <br /> Additionally, an archaeological test program must be conducted prior to the start of <br /> construction. BKF Engineers' sub-consultants will perform the archaeological test <br /> program and prepare a technical report for Caftans review and approval. <br /> This amendment will not cover the process that must be undertaken if a substantially <br /> intact significant cultural deposit is exposed during the test program or during <br /> construction that suggests a potential for focused data recovery, or if any bone is found <br /> and identified as human. If this occurs, consultation with Caltrans will be necessary and <br /> the archaeological data recovery of the mitigation plan will need to be initiated. The <br /> cost for archaeological data recovery cannot be accurately estimated as it is dependent <br /> on what is found and can range from $50,000 to $100,000 or more The task for <br /> archaeological data recovery is not included in BKF Engineers' scope of services. If <br /> archaeological data recovery is required, the data recovery will proceed per the <br /> mitigation plan and staff will request City Council's approval for another amendment to <br /> BKF's agreement to include archaeological data recovery. <br /> During construction, the design services of BKF Engineers is required to respond to <br /> requests for information from the contractor, review contractor submittals as required, <br /> provide archaeological monitoring, and attend meetings as required. After construction <br /> is completed, BKF will also prepare the construction record drawings. These additional <br /> services are considered extra work separate from the original scope of services. <br /> The scope of services and fee proposal ($162,200) for the fifth amendment to the <br /> professional services agreement with BKF Engineers is presented in Attachment 3. <br /> Construction Management and Inspection Services <br /> Staff advertised a Request for Proposal (RFP) package in April 2013 for both the I- <br /> 580/Foothill Road and I-680/Bemal Avenue Interchange Improvement projects. <br /> Carlson Management Inc. was the highest rated firm, and Bill Carlson has successfully <br /> managed the construction of other capital improvement projects for the City. <br /> On August 20, 2013, City Council approved the Professional Services Agreement with <br /> Carlson Management, Inc. in the amount of $666,377.62 for the construction <br /> management services for the I-580/Foothill Road and I-680Bemal Avenue Interchange <br /> Improvement projects. <br /> Page 4 of 6 <br />
