Chant Road serves as the main access route to the Quarry Lands and is <br /> subject to a high volume of heavy truck traffic related to the Quarry Lands. <br /> c. All property owners shall attach the following rider to each deed for any <br /> property within the Staples Ranch Site: <br /> Grantee hereunder acknowledges and agrees that the subject property is <br /> located in the vicinity of active and operating quarries and <br /> processing facilities. Grantee also acknowledges that quarry <br /> operations may result in airborne particulate matter, bright lights, noise <br /> and vibration, unattractive visual appearance, and heavy truck traffic on <br /> El Charro Road and adjacent streets and roadways within or <br /> outside the quarries. Grantee accepts possible inconvenience. of <br /> discomfort from any of the foregoing and Grantee hereby <br /> acknowledges and agrees that no claim of nuisance shall lie based on <br /> any of the foregoing. Grantee hereby covenants to include this same <br /> paragraph, in its entirety, in any subsequent deed by Grantee of all or any <br /> portion of the subject property. Grantee further covenants to include this <br /> same paragraph within any lease for all or any portion of the subject <br /> property. <br /> Stoneridge Drive Specific Plan Amendment/Staples Ranch Project <br /> Mitigation Monitoring and Reporting Plan <br /> 60. The subject project shall be implemented as required by the EIR and Mitigation <br /> Monitoring and Reporting Plan (MMRP). All mitigation measures of the <br /> Stoneridge Drive Specific Plan Amendment/Staples Ranch EIR are hereby <br /> incorporated by reference and shall be implemented as required by the EIR and <br /> MMRP. If any of the conditions of approval conflict with any applicable EIR <br /> mitigation measures, the requirements of EIR mitigation measures apply. <br /> 61. Prior to the issuance of a building permit, the project developer shall pay all traffic <br /> fees to which the property may be subject, as set forth in the Mitigation <br /> Monitoring and Reporting Plan. <br /> 62. In accordance with measure VQ-3.1 of the MMRP, all exterior lighting shall be <br /> directed downward and all perimeter lighting shall be shielded or utilize <br /> equivalent technology to avoid shining on neighboring properties. Energy <br /> efficient lamp technologies shall be incorporated wherever feasible (mercury <br /> vapor shall be avoided, and incandescent lights shall be avoided unless they are <br /> integrated with a control mechanism that limits their operation time).. The use of <br /> such lighting shall help minimize impacts on reduced visibility of the night sky. <br /> Plans submitted to the Building and Safety Division for permits shall demonstrate. <br /> compliance with this measure to the satisfaction of the Director of Community <br /> Development. <br /> PUD-98, CarMax Auto Superstores Page 9 <br />
