ATTACHMENT 1 <br /> ORDINANCE NO. <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> APPROVING THE APPLICATION OF CARMAX AUTO SUPERSTORES FOR <br /> PLANNED UNIT DEVELOPMENT (PUD) DEVELOPMENT PLAN APPROVAL, <br /> AS FILED UNDER CASE PUD-98 <br /> WHEREAS, CarMax Auto Superstores has applied for Planned Unit <br /> Development plan approval to construct an automobile dealership consisting of an <br /> approximately 11,783 square foot sales and presentation building, an approximately <br /> 45,000 square foot service building, an approximately 3,930 square foot quality control <br /> building and non-public car wash, vehicle sales display area, and related site <br /> improvements on approximately 19.66 acres of the Auto Mall site at Staples Ranch (the <br /> "Project"); and <br /> WHEREAS, zoning for the property is Planned Unit Development — Commercial <br /> (PUD-C) District; and <br /> WHEREAS, after a February 2014 workshop, at its meeting of April 9, 2014, the <br /> Planning Commission adopted Resolution PC-2014-14, determining that the proposed <br /> development plan is appropriate for the site, making findings, and recommending to the <br /> Pleasanton City Council that PUD-98 be approved; and <br /> WHEREAS, on May 6, 2014, the Pleasanton City Council held a duly noticed <br /> public hearing on this application and considered all public testimony, agenda reports, <br /> and related materials, and the recommendations of City staff and the Planning <br /> Commission; and <br /> WHEREAS, the City Council determined that the conditions described in <br /> California Environmental Quality Act (CEQA) Guidelines Section 15162 have not <br /> occurred as described in the Addendum to the EIR and SEIR and find that the <br /> previously prepared EIR and SEIR, including the adopted CEQA Findings and <br /> Statement of Overriding Considerations, and the Addendum to the EIR and SEIR are <br /> adequate to serve as the environmental documentation for this project and satisfy all the <br /> requirements of CEQA; and <br /> WHEREAS, the Pleasanton City Council finds that the proposed PUD <br /> development plan is consistent with the City's General Plan, the Stoneridge Drive <br /> Specific Plan Amendment/Staples Ranch and purposes of the PUD ordinance, and by <br /> this reference adopts and reaffirms all of the considerations and findings set forth in <br /> Planning Commission Resolution PC-2014-14. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> DOES HEREBY ORDAIN AS FOLLOWS: <br />
