and Pico Avenue, and that the developer shall enter into an <br /> agreement with the City Council obligating to pay his fair <br /> share as determined by City Council, of the cost of instal- <br /> lation of such a signal. <br /> <br />14. That there be a minimum of 300 ft. from center line to center <br /> line of those streets which intersect future Pico Avenue from <br /> the subject property and from the Mission Hill property (PUD- <br /> 79-10). <br /> <br />15. That the final design of the open space area and private drives <br /> shown on the plan shall be approved as part of the tentative <br /> subdivision map. <br /> <br />16. That prior to filing of a final map, CC&Rs shall be approved by <br /> the City Attorney. The CC&Rs shall provide for a Homeowners <br /> Association with sufficient power to manage all commonly owned <br /> areas (if any). The City shall be named aslbeneficiary of said <br /> CC&Rs and granted the power to enforce its provision if the <br /> Homeowners Association fails to do so. <br /> <br />17. That the developer shall pay any and all fees that the property <br /> may be subject to. <br /> <br />18. That the developer be reminded that specific approval from the <br /> City will be required prior to removal of any heritage trees <br /> and that preservation measures on tract and house development. <br /> <br />19. That the haul route to the site be approved by the City prior to <br /> construction. <br /> <br />20. That the following water conservation features be included in <br /> each home: a) low flush water closets; b) shower flow control <br /> heads; c) aerators in interior faucets; and d) insulation of hot <br /> water lines. <br /> <br />21. That all trees used in lanscaping be a minimum of 15 gallons in <br /> size and all shrubs a minimum of 5 gallons. <br /> <br />22. That the CC&R's shall provide a mechanism to insure that the <br /> privately owned open space shall be maintained in a healthy and <br /> weed free manner. <br /> <br />23. That the developer be aware that the project is subject to the <br /> Residential Allocation Program of the City of Pleasanton and <br /> that no building permits can be issued prior to allocation having <br /> been granted under the RAP. <br /> <br /> 24. That the developer be aware that this project will be subject to <br /> additional requirements under the Fire Code. The Fire Marshal <br /> should be contacted for further information. <br /> <br /> 25. That the applicant, working with the Mission Hill property owner, <br /> shall prepare a precise plan for the location of Pico Avenue from <br /> First Street east to at least Mirador Drive and that this plan <br /> shall be considered and approved as part of the tentative map on <br /> the subject property. <br /> 2 <br /> <br /> <br />
