Section 1 represents changes recommended by staff; Section 2 includes <br /> some additional changes requested by the neighbors which the City Council is being asked to <br /> consider. <br /> Only the conditions of approval with additions and/or changes are shown below, with <br /> changes shown in strikeout and underline. All other recommended conditions of approval <br /> are unchanged. <br /> Section 1: Changes and additions to the COAs recommended by staff. <br /> 5. Prior to the recordation of the Final Parcel Map, the applicants shall create a <br /> maintenance agreement including the maintenance responsibility of the driveway, <br /> retaining walls, common landscaping, bio-retention area, utilities, storm water <br /> treatment system, etc. in perpetuity. The maintenance agreement is subject to review <br /> and approval by the City Attorney's Office and shall be recorded concurrently with the <br /> Final Parcel Map. The Maintenance Agreement shall include exhibits showing the <br /> location of all the common private improvements to be maintained. The City shall be <br /> granted the rights and remedies of the agreement, but not the obligation, to enforce <br /> the maintenance responsibilities of the agreement. <br /> 16. The retaining wall shall be of shotcrete construction to create a natural-appearinq <br /> finish and where the wall height would be more than 6 feet, tiered walls shall be <br /> utilized with two walls approximately 3 feet apart. The design, color and materials <br /> shall be reviewed and approved by the Director of Community Development. <br /> 17. Prior to recordation of the Parcel Map, the applicant shall install up to two 36 inch <br /> Coast Live Oak trees behind the homes on Silver Oaks Lane, with at least one tree <br /> located on or near Lot 7 (2438 Silver Oaks Lane). Irrigation and maintenance of the <br /> trees shall be the responsibility of the home owner of the specific lot on Silver Oaks <br /> Lane and not the applicant. <br />
