disabled parking spaces display a special license plate or distinguishing placard. When
cited for violating this law, some persons contest the fine by explaining that their placard
was in the glove box, or had fallen and was not visible. Time and resources are needed
to issue the original citation, the Finance Department processes appeals, and a police
sergeant must review the appeal. It is recommended that for persons who park in a
disabled parking space but fail to display their qualified license plate or placard be
subject to a $25 penalty. This amount is similar to other `fix it' penalties (such as failure
to have an up-to-date registration sticker). This penalty amount is allowed by California
Vehicle Code §40226, with the goal of preventing fraud and encouraging persons to
properly display their placard.
Submitted by: Approved y:
Jonathan Lowell Nelson Fialho
City Attorney City Manager
Attachments:
1.
