- Section 9.30.050. Amend classifications to match those in existing utility billing <br /> system. Add "Special Landscape Area" customers as defined by the California Water <br /> Efficient Landscape Ordinance, Government Code §65591 et. seq. <br /> - Section 9.30.060. Revise stages to match Urban Water Management Plan, and <br /> delete references to 1990-91 water usage amounts. <br /> - Sections 9.30.070 - 9.30.120. Consolidates these sections to describe how <br /> water conservation is calculated. Director of Operation Services to determine reduction <br /> based on prior year, or average usage from similar billing periods and customer's prior <br /> average usage from 1 to 4 prior years, if available. For example, average July & August <br /> 60 day water usage from 2010 = 32 units, 2011 = 28 units, 2012 = 34 units and 2013 = <br /> 26 units; 4 year average is 30 units; if Stage 2 m andatory 20% reduction then maximum <br /> use in July & August 2014 = 24 units. Also allows consideration of other data if <br /> insufficient historic usage. <br /> - New Section 9.30.080. Revise existing conservation measures and their <br /> applicability at each stage of any declared water shortage. These include new <br /> conservation m easures from the Urban Water Management Plan, Tri-Valley Water <br /> Retailers Water Shortage Contingency Plan adopted in 2009, best practices from other <br /> agencies such as EBMUD, and reflects more current resources such as recycled water. <br /> Conservation measures are cumulative, as stated in the code, such that measures from <br /> Normal Supply and Stage 1 voluntary 20% all apply plus the listed Stage 2 measures if <br /> a Stage 2 mandatory 20% reduction is declared by the City Council. <br /> - Old Section 9.30.130 / New Section 9.30.090. Preserves the provision for <br /> administrative emergency shut-off. <br /> - Old Section 9.30.140 / New Section 9.30.100. This section originally provided <br /> for the City Council to adopt penalties for excess water usage as part of the Master Fee <br /> Schedule. Penalties were adopted in Resolution 91-59, and increased in amount as the <br /> stage of water shortage increased. Penalties are now proposed to be stated directly in <br /> the municipal code. The penalties start at an additional $2 for all units on the water bill <br /> when the customer does not achieve mandatory reduction. Regular water costs are <br /> $1.97 to $3.23 per unit. Additional penalties apply for customers who repeatedly fail to <br /> meet reduction goals, and penalties increase as the stage of water emergency becomes <br /> more severe. <br /> - Old Section 9.30.160 / New Section 9.30.120. Appeals regarding director's <br /> adjustments are proposed to be appealable to City Manager, whose consideration of a <br /> written appeal is final. Adjustments can be granted for health and safety considerations, <br /> economic hardship, medical requirements, or unusual household size.
