2. Approve the Fourth Amendment to Agreement with BKF Engineers to finalize the <br /> PS&E for the landscape and gateway design, obtain a Caltrans encroachment <br /> permit rider for the landscape and gateway construction, and provide services during <br /> the advertising and bidding period to respond to questions from contractors and <br /> assist the City in preparing contract addenda as needed. Section 4 of the <br /> agreement is amended to increase compensation by $77,000 for a total <br /> compensation of$449,066. <br /> 3. Authorize the City Manager to execute the Fourth Amendment to Agreement. <br /> FINANCIAL STATEMENT <br /> Sufficient funds are available in the Bernal Interchange Reserve project (CIP No. <br /> 005068) to fund the additional cost of both the Third Amendment ($74,400) and the <br /> Fourth Amendment ($77,000). <br /> BACKGROUND <br /> The City of Pleasanton entered into a development agreement in October of 2000 with <br /> GHC Bernal Investors. Included within the development agreement were provisions for <br /> the payment and construction of the 1-680 at Bernal Avenue interchange improvements. <br /> Although the City is responsible for construction of the improvements, the cost of the <br /> construction will be the responsibility of the developers. <br /> In September 2010, the City Council approved a Professional Services Agreement with <br /> BKF Engineers to prepare the project plans, specifications and estimates and <br /> environmental documentation for the Bernal Avenue at 1-680 Improvements for a not to <br /> exceed amount of$297,666. <br /> DISCUSSION <br /> Caltrans has required that an archaeological test program be completed and a technical <br /> report be submitted to Caltrans for review and approval prior to the start of any <br /> construction activity. As a result, BKF Engineers and their sub consultant will perform <br /> an archaeological test program and prepare the technical report for Caltrans' review and <br /> approval. During the development of the final plans, the project work plan was <br /> expanded to include new curb ramps and pedestrian signals at the intersection of <br /> Bernal Avenue and W. Lagoon Road to improve the pedestrian facility. Also, additional <br /> drainage improvements are required under 1-680, and recent electrical work completed <br /> by Caltrans at the interchange will require modifications to the plans. BKF Engineers' <br /> services are required during the bidding process in order to respond to questions from <br /> contractors, attend meetings, and assist City staff in preparing contract addenda as <br /> needed. These additional services are included in the Third Amendment (Attachment 1) <br /> that was approved by the City Manager to keep the interchange project moving forward <br /> in order to avoid cost increases to the project. <br /> During the development of the PS&E, it was decided that the landscape and gateway <br /> elements of the project would be phased and constructed separately from the roadway <br /> improvement project. The landscaping was removed from the first phase of the contract <br /> in an attempt to expedite the Caltrans permitting process. Caltrans has issued an <br /> encroachment permit for the construction of roadway improvements. BKF Engineers <br /> Page 2 of 3 <br />
