BACKGROUND <br /> In July 2012, StopWaste adopted the Mandatory Recycling Ordinance (MRO) requiring <br /> actions to reduce landfilling of recyclables and organics from businesses, multi-family <br /> residences, and self-haulers. The MRO requires commercial businesses with 4 or more <br /> cubic yards of waste each week and multi-family developments with five units or more <br /> to subscribe to mandatory recycling services. A copy of the ordinance is included as <br /> Attachment 2. <br /> The MRO has two implementation phases. Phase 1, which is currently in place and <br /> includes dry recyclables such as cardboard, white paper, newspaper, metal, glass, <br /> plastics, etc., was implemented in Pleasanton earlier this year. As noted, Phase 1 <br /> affects only businesses with 4 cubic yards or more of solid waste collection service per <br /> week and multi-family buildings with five or more residential dwelling units. Phase 2, <br /> which covers discarded food and compostable paper, is scheduled to begin July 1, <br /> 2014. Initially, Pleasanton opted out of Phase 1 to allow time to complete the refuse and <br /> recycling analysis underway at that time with the intent to opt in when refuse and <br /> recycling rates were approved. Pleasanton opted back in to Phase 1 on October 2, <br /> 2012. <br /> Cities are required to inform StopWaste by resolution of its intent to opt-in or opt-out of <br /> Phase 2 by the end of this calendar year. If Pleasanton takes no action, then it is <br /> considered to have opted-in to the ordinance thus requiring local businesses and multi- <br /> family developments to meet Phase 2 requirements and to subscribe for the separate <br /> collection of discarded food and compostable paper commencing July 1, 2014. <br /> DISCUSSION <br /> In view of the Phase 2 requirements, staff has identified the following four options for <br /> City Council consideration: <br /> 1. Opt-in <br /> City Council Action Required: No action needed. <br /> Implications: The City is required to assure that service is available through <br /> Pleasanton Garbage Service (PGS) and businesses are required to have service <br /> that assures the covered material is collected separately. Staff and PGS have not <br /> yet addressed appropriate collection processes and fees for Phase 2 services. <br /> 2. Opt-out <br /> City Council Action Required: Adoption of a resolution prior to the end of 2013 <br /> indicating its intent to opt-out. <br /> Page 2 of 5 <br />
