Market:Northern California <br /> Cell Site Number:CNU0413 <br /> Search Ring Name:Livermore <br /> Cell Site Name:Livermore(CA) <br /> Fixed Asset Number:10087959 <br /> Lease Execution Charge ($2,500.00) mailed to the City of Livermore, Attention: Finance Dept. <br /> Accounts Receivable, 1052 S. Livermore Avenue, Livermore, CA 94550, and (ii) a separate <br /> check for 50% of the Lease Execution Charge ($2,500.00) mailed to the City of Pleasanton <br /> Attention: Finance Director, P.O. Box 520, Pleasanton, CA 94566. <br /> (b) Base Rent. The parties acknowledge and agree that as of the date immediately prior <br /> to the Effective Date, Lessee pays rent to City in the amount of One Thousand Five Hundred <br /> Eighty-One and 79/100 Dollars ($1,581.79). Commencing upon the Effective Date, Lessee shall <br /> pay Cities, as rent, the sum of Three Thousand Eight Hundred and No/100 Dollars ($3,800.00) <br /> ("Base Rent") per month. The Lessee shall pay a pro-rata share of the Base Rent in the first <br /> month of the Lease Agreement based on the Effective Date. Lessee's first Base Rent payment <br /> to the Cities shall be made within thirty (30) days of the Effective Date. Thereafter, Lessee shall <br /> pay the Base Rent to the Cities in advance on the first day of each month during the Term of <br /> this Lease Agreement. If that date falls on a weekend or a legal holiday, the Base Rent is due <br /> on the next business day. The payments are to be made to the Cities as follows: (i) one check <br /> for 57% of the Base Rent mailed to the City of Livermore, Attention: Finance Dept. Accounts <br /> Receivable, 1052 S. Livermore Avenue, Livermore, CA 94550, and (ii) a separate check for <br /> 43% of the Base Rent mailed to the City of Pleasanton Attention: Finance Director, P.O. Box <br /> 520, Pleasanton, CA 94566. <br /> (c) Rent Adjustment. On July 1st every year during the Initial Term and the Extended <br /> Term, the Base Rent shall be increased by the greater of either (i) three percent (3%), or (H) the <br /> percentage increase in the U.S. Department of Labor, Bureau of Labor Statistics, Consumer <br /> Price Index, 'Table 3-for all Urban Consumers (CPI-U): Selected Areas, all items index" for San <br /> Francisco-Oakland-San Jose during the preceding one (1) year period. If the CPI is <br /> discontinued or revised, such other government index or computation with which it is replaced <br /> shall be used in order to obtain substantially the same result as if the CPI has not been <br /> discontinued or revised. <br /> (d) Additional Rent on Antenna Site or Outside Leased Areas. In the event that Lessee <br /> requests and the Cities approve the installation of additional antenna on the Tower above the <br /> approved configuration shown in Attachment B (twelve (12) panel antennas, nine (9) RRUS-11, <br /> and a DC-6 surge protector), Lessee shall pay the sum of Two Hundred Dollars ($200.00) per <br /> month ("Additional Tower Rent"), in addition to the Base Rent, for each additional antenna <br /> installed, which Additional Tower Rent shall commence upon the first (1st) day of the month <br /> following the commencement of installation of the applicable antenna. In the event that Lessee <br /> requests and the City approves the installation of additional equipment outside of the Leased <br /> Area as shown in Attachment B, additional rent may be required as negotiated between City <br /> and Lessee ("Additional Ground Space Rent") in addition to the Base Rent, which Additional <br /> Ground Space Rent shall commence upon the first (1st) day of the month following the <br /> commencement of installation of the applicable equipment. The additional rent in either case <br /> shall be distributed to the Cities pursuant to section 5(b) above. <br /> (f) Deposits. To secure the performance of its obligations under this Lease Agreement, <br /> the Lessee is required to make the following deposits with the City within thirty (30) days of the <br /> Effective Date: <br /> (1) General Performance Bond: The Lessee shall furnish to and maintain <br /> with the City, in a form acceptable to the City's Attorney, a non-revocable performance- <br /> Lease for Installation of Telecommunications Equipment-Final Page 4 <br />
