Market Northern California <br /> Cell Site Number:CNU0413 <br /> Search Ring Name:Livermore <br /> Cell Site Name:Livermore(CA) <br /> Fixed Asset Number:10087959 <br /> 1. Recitals. The aforementioned recitals are true and correct. <br /> 2. Leased Areas. <br /> (a) Description. For and in consideration of the mutual terms, covenants and <br /> conditions contained herein, the following areas are leased by this Lease Agreement. <br /> (1) Premises. City leases to Lessee and Lessee leases from City a portion of <br /> the Property identified in Attachment "B", attached hereto and incorporated herein by reference <br /> ("Premises"). The Premises shall consist of only areas needed for the equipment shelter, <br /> microwave dish, utility service lines and emergency generator as described below in Section 3. <br /> (2) Antenna Site: City and Pleasanton lease to Lessee, and Lessee leases <br /> from City and Pleasanton space on the Tower for the placement of antennae in the location <br /> identified in Attachment "B", attached hereto and incorporated herein by reference ("Antenna <br /> Site"). <br /> (3) Leased Areas: The Premises and Antenna Site shall be collectively <br /> referred to in this Lease Agreement as the "Leased Areas." <br /> (b) Appurtenant Rights. The appurtenant rights granted by this Lease Agreement <br /> are as follows: <br /> (1) For the duration of this Lease Agreement, including any extensions <br /> thereof, Lessee is hereby granted a non-exclusive access over, in, and across the Property's <br /> common areas to the Premises and across to the Antenna Site for the limited purpose of <br /> installing, maintaining, servicing, replacing, and operating Lessee's Antenna and Equipment as <br /> those items are defined in sections 3(a) and 3(b) below. <br /> The right of access is limited to Lessee, its employees, agents and designated representatives, <br /> and is expressly conditioned upon Lessee's compliance with all terms and conditions of this <br /> Lease Agreement. <br /> The right of access does not grant Lessee any right across, over or through any occupied areas <br /> on the Property or Tower. <br /> (2) Lessee shall establish a non-exclusive utilities path for the connection of <br /> utilities to the Leased Areas in this Lease Agreement, but shall coordinate with City regarding <br /> the placement of such utilities in joint trenching. City hereby grants to Lessee a license coupled <br /> with an interest for this purpose <br /> 3. Equipment and Antenna. Lessee is responsible for conducting its own engineering and <br /> analysis of the Equipment and Antenna, including a review to ensure that the Equipment and <br /> Antenna which are placed on the Tower are engineered and designed to meet the Tower's <br /> specifications without compromising the integrity of the Tower or its use by City or other lessees <br /> on the Tower or Property. <br /> (a) Antenna. Lessee has installed twelve (12) panel antennas identified in Attachment <br /> "B" ("Antenna") at the Antenna Site for the operation of a telecommunications system. <br /> Lease for Installation of Telecommunications Equipment-Final Page 2 <br />
