ORDINANCE NO. 880 j "
Page 2

Section 3. The Council finds that a substantial number of condominium
conversions undertaken during the period in which the City
Council and Planning Commission will be studying the
condominium conversion problem and considering a proposed
condominium conversion ordinance, is a threat to the
public health, safety and welfare, requiring this interim
ordinance. Adoption of this ordinance will preclude
premature condominium conversion applications based on
speculation about the future condominium conversion
ordinance. The factual basis for this emergency ordinance
is the recent interest and increase in applications for
condominium conversions.
Section 4. During the period of the moratorium established herein,
no approval shall be given to convert any proposed apart-
ment or multiple dwelling to a condominium. The Council
expressly finds that in view of the limited amount of low
and moderate income housing available in the community
at the present time, any conversion of a significant
number of units would, in the absence of this moratorium,
be denied, on the grounds that such conversion is incon-
sistent with the adopted General Plan of the City, which
establishes a goal of 13% low and moderate income housing
in order to make adequate provision fir the housing needs
of all economic segments of the community.

Section 5. For purposes of this ordinance, the following definitions
shall apply:
COmmUNITY APARtmENT PROJECT: A project in which an
undivided interest in the land is coupled with the
right of exclusive occupancy of any apartment located
thereon. For the purposes of this ordinance, community
apartment projects will be subject to the same restrictions
and conditions as condominium projects.
