ORDINANCE NO. 880 j " <br />Page 2 <br /> <br />Section 3. The Council finds that a substantial number of condominium <br /> conversions undertaken during the period in which the City <br /> Council and Planning Commission will be studying the <br /> condominium conversion problem and considering a proposed <br /> condominium conversion ordinance, is a threat to the <br /> public health, safety and welfare, requiring this interim <br /> ordinance. Adoption of this ordinance will preclude <br /> premature condominium conversion applications based on <br /> speculation about the future condominium conversion <br /> ordinance. The factual basis for this emergency ordinance <br /> is the recent interest and increase in applications for <br /> condominium conversions. <br />Section 4. During the period of the moratorium established herein, <br /> no approval shall be given to convert any proposed apart- <br /> ment or multiple dwelling to a condominium. The Council <br /> expressly finds that in view of the limited amount of low <br /> and moderate income housing available in the community <br /> at the present time, any conversion of a significant <br /> number of units would, in the absence of this moratorium, <br /> be denied, on the grounds that such conversion is incon- <br /> sistent with the adopted General Plan of the City, which <br /> establishes a goal of 13% low and moderate income housing <br /> in order to make adequate provision fir the housing needs <br /> of all economic segments of the community. <br /> <br />Section 5. For purposes of this ordinance, the following definitions <br /> shall apply: <br /> COmmUNITY APARtmENT PROJECT: A project in which an <br /> undivided interest in the land is coupled with the <br /> right of exclusive occupancy of any apartment located <br /> thereon. For the purposes of this ordinance, community <br /> apartment projects will be subject to the same restrictions <br /> and conditions as condominium projects. <br /> <br /> <br />
