Supply Agreement as the "Tertiary Treatment Plant Facilities." <br /> h. Recycled Water Transmission System – The DERWA pumping, pipeline and <br /> storage facilities that receive Recycled Water from the Recycled Water <br /> Treatment Facility, and which DERWA now uses to deliver Recycled Water to <br /> the District's and EBMUD's respective Recycled Water Distribution Systems, <br /> and which in the future will also deliver Recycled Water to the City's Recycled <br /> Water Distribution System in accordance with the terms of this Agreement and <br /> the City-DERWA Agreement. <br /> i. Recycled Water Distribution System – The various District, EBMUD, and, in <br /> the future, City pipelines that convey Recycled Water from the Recycled Water <br /> Transmission System to the respective end-user customers of each retail <br /> agency. <br /> j. Tassajara Reservoir – The rectangular concrete reservoir with an 8 million <br /> gallon capacity and a finished floor elevation of 491 feet, located below surface <br /> grade at 5450 Tassajara Road in Dublin, California, that is owned and operated <br /> by the City. <br /> 3. Integration Benefit. Integrating the District and the City Recycled Water <br /> Programs pursuant to this Fifth Supplemental Agreement initially benefits the <br /> District Recycled Water Program more than it benefits the City Recycled Water <br /> Program, so within thirty (30) days of the effective date of this Fifth Supplemental <br /> Agreement, the District shall pay the City a lump sum of one hundred and twenty <br /> five thousand dollars ($125,000), which funds shall not originate from any of the <br /> District's Regional Sewer Funds (to which the City contributes as specified in the <br /> Basic Agreement). <br /> 4. Use of Secondary Effluent. The Parties shall maximize the recycling of <br /> Secondary Effluent produced by the Regional Sewerage Facilities for beneficial <br /> use. Notwithstanding Section 9(b) of the Basic Agreement, District shall have the <br /> right to utilize—for supplying to DERWA pursuant to the Water Supply Agreement <br /> (as defined above) for delivery by DERWA, pursuant to the Water Sales <br /> Agreement (as defined above), to the DSRSD Recycled Water Program and to the <br /> Page 5 of 19 <br />
