RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, CALIFORNIA, TO WTIHDRAW FROM PARTICIPATION IN THE TRI-VALLEY WATER RETAILERS COOPERATION AGREEMENT WHEREAS, the City of Pleasanton executed the Tri-Valley Water Retailers Cooperation Agreement ("Agreement") on April 1, 2003, formed by the City of Livermore and the Dublin San Ramon Services District on August 22, 2002; and WHEREAS, on September 27, 2003 the California Water Services Company executed the Agreement; and WHEREAS, the four parties to the Agreement, collectively known as the "Retailers," have successfully carried out the purpose of the Agreement to "...influence Zone 7 decisions that assure there will be adequate supplies to meet demands in the future;" and WHEREAS, the Retailers forged a cooperative working relationship with Zone 7 and now find that the purpose of the Agreement can be more efficiently achieved with the Retailers and Zone 7 working together; and WHEREAS, the Retailers intend to meet jointly with Zone 7 on a regular basis at the policy-maker level as a Joint Liaison Committee to discuss issues of common interest associated with water supply, water quality, infrastructure and finances; and WHEREAS, to discuss issues of mutual interest, Retailer staff members will continue to meet on a regular basis. NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: SECTION 1. Authorize City staff to send a letter to the other Retailers notifying of the City's withdraw from participation in the Tri-Valley Retailers Cooperation Agreement and direct staff to take other actions necessary to complete termination of the Agreement. SECTION 2. City Clerk shall certify to the passage of this resolution and enter it into the book of original resolutions.
