III. DISPUTE RESOLUTION PROCESS <br /> A. Initiation of Request. The City Manager may meet on an issue or issues of <br /> interest to a Resident or the Property Owner, including the calculations used for a rent increase. <br /> The request must be in writing but shall not require any particular number of signatures beyond <br /> that of the person making the request. The request must identify the problem(s)to be addressed <br /> by the City Manager and may recommend a solution. <br /> B. Prerequisite to Request. The City Manager may consider a request only after the <br /> following events have occurred: <br /> 1. In the case of a Resident requesting a dispute be resolved, the Resident <br /> making the request has submitted the issue in writing to the Property Owner's <br /> representative. In the case of the Property Owner requesting a dispute be resolved, the <br /> Property Owner making the request has presented the issue to the Residents at an all Park <br /> meeting. <br /> 2. A satisfactory resolution of the issue has not been achieved within 30 days <br /> from submittal of the issue under subsection B1 above. <br /> C. The City Manager may select whatever staff members, experts, professionals, <br /> trades people, or other resources he or she deems necessary to assist in reviewing the request. <br /> The City Manager may coordinate efforts towards resolution of disputes with the California <br /> Department of Housing and Community Development's Mobilehome Ombudsman. <br /> D. By entering into this agreement the parties agree that the City Manager has broad <br /> powers to resolve disputes raised in accordance with the provisions of this Agreement. The City <br /> Manager's authority includes, but is not limited to, the power to encourage the parties to make <br /> payments or refunds or credits, to refuse to hear or act upon complaints that are trivial or can be <br /> resolved through other means, or to take other actions in order to fairly resolve disputes that arise <br /> out of the administration of this Agreement. In addition, the City Manager is authorized to use a <br /> mediator to resolve a dispute, the cost of which will be borne evenly between the Property <br /> Owner and the City. The Property Owner consents to participate in and pay 50% of the cost for <br /> such mediation in the event the City Manager determines mediation should be utilized. <br /> E. Dispute Resolution. If the City Manager is unable to resolve the issue to the <br /> satisfaction of all parties, the procedures of Chapter 1.28 of the Pleasanton Municipal Code <br /> (Administrative Remedies) shall be employed to resolve the dispute. For purposes of that <br /> Chapter, the Director shall mean an Assistant or Deputy City Manager of the City of Pleasanton. <br /> The parties understand that pursuant to section 1.28.090 (Administrative penalties) of the <br /> Pleasanton Municipal Code, in the case of a finding by the hearing officer of a violation of this <br /> Agreement or the Pleasanton Municipal Code, the hearing officer may impose administrative <br /> Agreement Providing for Stabilization of Mobilehome Space Rents <br /> October 1,2013 <br /> 4 <br />
