F. "Mobilehome Park" or "Park" means any area or land within the City of <br /> Pleasanton where two (2) or more mobilehome spaces are rented, or held out for rent, to <br /> accommodate mobilehomes used for human habitation. These terms also refer to the Hacienda <br /> Mobilehome Park. <br /> G. "Monthly rent" is the monthly space rent for each mobilehome space. A schedule <br /> of the monthly rents of all spaces as of October 1, 2013 is attached and incorporated herein as <br /> Exhibit A. <br /> H. "Property Owner" or"Park Owner" is the owner of the Hacienda Mobilehome <br /> Park within the City of Pleasanton. <br /> I. "Resident" or "tenant" means any homeowner or other person who lawfully <br /> occupies a mobilehome in the Hacienda Mobilehome Park. <br /> J. "Service reduction" means any reduction in housing services which results in a <br /> cost savings to the Property Owner without a corresponding reduction in the monies demanded <br /> or paid for space rent. <br /> K. "Space rent" means the consideration, including any bonus, benefits, or gratuity, <br /> demanded or received in connection with the use and occupancy of a mobilehome park or for the <br /> transfer of a lease for park space, services and amenities, subletting and security deposits, but <br /> exclusive of any amounts paid for the use of the mobilehome dwelling unit. <br /> L. "Transfer of ownership" means any voluntary or involuntary sale, assignment or <br /> transfer of ownership of a mobilehome or of any interest in the mobilehome, including, but not <br /> limited to, a fee simple interest, a joint tenancy interest, a life estate, or an interest evidenced by a <br /> land contract by which possession of the mobilehome is transferred and the resident retains title, <br /> but excluding transfers by a living trust, lease, gift, devise or inheritance to an existing spouse, <br /> domestic partner, or surviving joint tenant, or a spouse or domestic partner as part of a <br /> dissolution proceeding or in connection with entering into marriage or domestic partnership. <br /> II. RENT STABILIZATION ORDINANCE <br /> The City has adopted a Mobilehome Rent Stabilization Ordinance, codified at Chapter <br /> 6.60 of the Pleasanton Municipal Code. The Property Owner who is signatory to this agreement <br /> and who is operating its Park in compliance with this Agreement shall be exempted from the <br /> Ordinance during the term of this agreement, except where the Ordinance is specifically made <br /> applicable by the terms of this Agreement. Except as otherwise provided herein, issues <br /> concerning whether the Property Owner is operating the Park in good faith compliance with this <br /> Agreement shall be resolved as provided in Article III. <br /> Agreement Providing for Stabilization of Mobilehome Space Rents <br /> October 1,2013 <br /> 3 <br />
