(b) With the unit pricing described in 1(a), above, the Association will be able to calculate <br /> specific cost for any and all LEDs, brackets, photocells and shields, as well as the <br /> additive item for GPS data collection for which the Association is responsible and that <br /> the Association desires to have upgraded as part of the City's LED project. <br /> (c) The Association acknowledges that the City reserves the right in its absolute discretion <br /> not to proceed with the contemplated LED upgrade project. <br /> 2. Association Decision to Proceed and Final Cost. <br /> (a) The City received bids on August 8, 2013 in response to the call for bids and the City is <br /> prepared to select the lowest qualified bidder and award the contract, and the Association <br /> shall have the option to proceed with the LED upgrade for all or a portion of the 783 <br /> street lights within Hacienda for which the Association is responsible for electricity, <br /> repair and maintenance. <br /> (b) By initialing here on this day of 2013, the Association has elected <br /> to proceed with the LED upgrade based on the following prices, which include shipping <br /> and installation costs, catalog number, and specific lights and a photocell for each light (if <br /> the Association elects to proceed then the information below shall be added after <br /> execution of this Agreement, and which information the parties acknowledge are <br /> approximate quantities, particularly the long mounting bracket and backlight control <br /> shield for which in field conditions will determine if such items are needed for each LED, <br /> to be finalized in the reconciliation described in subsection (d), below): <br /> Item Quantity Unit of Item Description Unit Total <br /> No. (approx.) measure Price <br /> Each Replace 70 Watts HPSV with <br /> 38 Watts 4000K LED <br /> 2.
