ATTACHMENT 1 <br />ORDINANCE NO. <br />AN ORDINANCE APPROVING AN APPLICATION FOR A PLANNED UNIT <br />DEVELOPMENT (PUD) MAJOR MODIFICATION TO THE APPROVED PUDS <br />(PUD -81 -30 AND PUD- 85 -08) GOVERNING HACIENDA BUSINESS PARK TO <br />ADDRESS RESIDENTIAL DEVELOPMENT AND HOW IT AFFECTS THE <br />DEVELOPABLE SQUARE FOOTAGE IN HACIENDA BUSINESS PARK <br />(HACIENDA), AS FILED UNDER CASE NOS. PUD- 81- 30 -55M AND <br />PUD- 85- 08 -27M <br />WHEREAS, the City of Pleasanton applied for a Planned Unit Development <br />(PUD) Major Modification to address residential development and how it affects the <br />developable square footage in Hacienda Business Park; and <br />WHEREAS, at its meeting of August 28, 2013, the Planning Commission held a <br />noticed public hearing and considered all public testimony, relevant exhibits, and <br />recommendations of City staff concerning the application, and recommended approval <br />of the PUD Major Modification and amendment of Condition of Approval No. 2.D. of City <br />Council Ordinance No. 1596 to exclude seven specific sites from the total gross floor <br />area within Hacienda; and <br />WHEREAS, a duly noticed public hearing was held on September 17, 2013, <br />where the City Council received a report from the Director of Community Development <br />regarding this application; and <br />WHEREAS, at the public hearing on September 17, 2013, the applicant and <br />other members of the public were offered an opportunity to present evidence regarding <br />the application; and <br />WHEREAS, the City Council determined that the conditions described in <br />California Environmental Quality Act (CEQA) Guidelines Section 15162 have not <br />occurred and found that the previously prepared Supplemental Environmental Impact <br />Report (SEIR), including the adopted CEQA Findings and Statement of Overriding <br />Considerations in City Council Resolution 12 -492, are adequate to serve as the <br />environmental documentation for the Project and satisfy all the requirements of CEQA; <br />and <br />WHEREAS, the Pleasanton City Council finds that the proposed amendment to <br />the PUD is consistent with the City's General Plan and purposes of the PUD ordinance; <br />and <br />WHEREAS, The City Council finds that based on substantial evidence the <br />conditions described in California Environmental Quality Act (CEQA) Guidelines §15162 <br />have not occurred and finds that the previously prepared Supplemental Environmental <br />Impact Report (SEIR) for the City of Pleasanton Housing Element and Climate Action <br />
