executed between the City of Pleasanton and the SouthBay Development and <br />recorded at the Alameda County Recorder's office; <br />C) Annual inspection, maintenance, and /or repair of all private driveways, streets and <br />courts, and open parking spaces; <br />d) Annual inspection, maintenance, and /or repair of the landscaping and irrigation <br />lines within the planter strip between the sidewalk and curb along Valley Avenue; <br />e) Annual inspection, maintenance, and /or repair of all common open space areas <br />and trails, landscape and irrigation, and fencing; <br />f) Annual inspection, maintenance, and /or repair of the entire recreation area, <br />building, and equipment; and, <br />g) Maintenance responsibilities of the shared access driveways to Bernal Avenue <br />and Valley Avenue defined in the "Reciprocal Easement and Maintenance <br />Agreement" recorded on December 15, 2010 (Alameda County Recorder's No. <br />2010376767). <br />The CC&R's shall be subject to the review and approval of the City Attorney prior to <br />recordation of the first final subdivision map. The City shall be granted the rights and <br />remedies of the association, but not the obligation, to enforce the maintenance <br />responsibilities of the association. All proposed revisions and /or changes to the CC&R's <br />shall be first forwarded to the City Attorney's office for review and comment prior to their <br />approval by the Homeowner's Association. <br />65. The project developer and then the Homeowners Association shall provide Livermore <br />Amador Valley Transportation Authority ( LAVTA) transit passes to all residents of this <br />development at a 50% ticket price discount for the first year of occupancy for use on the <br />LAVTA transit system. <br />Landscape and Irrigation Design <br />66. All phases of the project covered by Exhibit B shall comply with the State of California's <br />Water Efficient Landscape Ordinance and Bay Friendly Basics Landscape Requirements. <br />A licensed landscape architect shall verify the project's compliance with the ordinance and <br />checklist: 1) prior to the issuance of a building permit; and 2) prior to final inspection. The <br />verification shall be provided to the Planning Division. <br />67. A final landscape and irrigation plan shall be submitted to and approved by Director of <br />Community Development as part of the improvement plans and as part of the building <br />permit plans prior to issuance of a building permit. Said landscape plan shall be detailed <br />in terms of species, location, size, quantities, and spacing. Plant species shall be of <br />drought - tolerant nature and the irrigation design shall utilize low- volume drip, bubbler, or <br />other water conserving irrigation systems to the maximum extent possible. <br />68. All irrigation systems shall meet all requirements for compatibility with future recycled <br />water supply per City of Pleasanton Recycled Water Standards. <br />Page 12 <br />
