ATTACHMENT 1 <br /> FIRSTAMENDMENT TO CONTRACT FOR DESIGN PROFESSIONAL SERVICES <br /> This First Amendment to Design Professional Services Agreement for Bernal Community Park, <br /> Phase 2 is entered into June 19, 2013, between the City of Pleasanton (City) and Harris Design, <br /> whose address in 6515 Ascot Drive, Oakland, CA 94611 and telephone number is (510) 336- <br /> 9292 (Consultant). <br /> Recitals <br /> Whereas, on October 22, 2008, City and Consultant entered into the Design Professional <br /> Services Agreement for Bernal Community Park, Phase 2 (Agreement) concerning the design of <br /> the Bernal Community Park, Phase II including lighted multi-purpose all weather sports fields <br /> and park amenities; <br /> Whereas, shortly after commencing work on the Agreement, City requested Consultant <br /> suspend work pending City identification of project development and construction funding; <br /> Whereas, on September 18, 2012, the Pleasanton City Council approved a preliminary <br /> project financing plan and authorized Consultant to resume activities related to the Agreement; <br /> Whereas, since the resumption of work, City and Consultant have refined park elements, <br /> including the Oak Woodland area, and identified a project development budget which is included <br /> in the City's 2013-14 through 2016-17 Capital Improvement Program; <br /> Whereas, in response to City's request to included the Oak Woodland area as part of the <br /> project scope and to adjust service fees to be consistent with the refined park elements, <br /> Consultant has submitted a revised scope of work and associated fee schedule. <br /> Now, therefore, in exchange for valuable consideration, the receipt of which is hereby <br /> acknowledged, the parties agree as follows: <br /> 1. Exhibit A to Section 1 of the Agreement is hereby amended to include the scope of <br /> work as detailed in Attachment 1 to this First Amendment <br /> 2. The not to exceed fees for the services as included in this First Amendment are <br /> $127,771 plus a 5% contingency of$6,400 to a total contract value of$134,171. <br /> 3. Total compensation for all services and reimbursement listed under Section 5 of the <br /> Agreement shall be adjusted from $765,000 to $899,171. <br /> 4. The term of the Agreement is amended to December 31, 2014. <br /> 5.
