Water Agency or the City of Pleasanton's Utility Planning Division that water is <br /> available for the project. To receive the verification, the applicant may need to <br /> offset the project's water demand. This approval does not guarantee the <br /> availability of sufficient water capacity to serve the project. <br /> Site(s) affected: All <br /> (Draft SEIR, pp. 4.L-13 to 4.L-16.) <br /> K. Significant Impacts That Cannot be Mitigated to a Less Than Significant <br /> Level <br /> The following significant impacts cannot be mitigated to a less-than-significant <br /> level, even with the implementation of the identified mitigation measures set forth below. No <br /> mitigation is feasible that would mitigate these impacts to a less-than-significant level. The City <br /> has determined that the impacts identified below are acceptable because of overriding <br /> economic, legal, social or other considerations, as described in the Statement of Overriding <br /> Considerations. As required by CEQA, a Statement of Overriding Considerations is presented <br /> in Section II below in addition to these findings. <br /> 1. Cultural Resources <br /> Impact 4.D-1 <br /> Development facilitated by the General Plan Amendment and rezonings has the <br /> potential to adversely change the significance of historical resources. <br /> The SEIR evaluates the impact of the proposed project related to the potential to <br /> adversely change the significance of historical resources. Construction activities such as <br /> grading and excavation associated with development on the potential sites for rezoning <br /> identified in the proposed Housing Element could potentially affect known historic or cultural <br /> resources. Specifically, Site 6 is the location of an ice house and farmhouse complex that may <br /> be historic as they are more than 50 years old and Site 21 includes an early 20th century home <br /> within an historic neighborhood identified in the General Plan. <br /> Significance Before Mitigation: Significant <br /> Significance After Mitigation: Significant and Unavoidable <br /> Finding: Changes or alterations have been required in or incorporated into the <br /> Project, however, the changes would not reduce this impact to a less than <br /> significant level. Mitigation Measures 4.D-1a and 4.0-lb are required in or <br /> incorporated into the Project. <br /> Facts in Support of Finding: The following facts and mitigation measures indicate <br /> that the impact will not be reduced to less than significant. <br /> 1. Cultural resources would be directly adversely affected by <br /> development on the potential sites for rezoning if they are demolished to make <br /> way for new housing, or indirectly affected, through incompatible design of new <br /> development adjacent to the resource. <br />
