2. Implementation of Mitigation Measure 4.D-4 set forth in <br /> Table 6-1 of the Final SEIR and listed in the MMRP will ensure that Impact 4.0-4 <br /> would be reduced to a less than significant level and is hereby incorporated by <br /> reference and described below: <br /> 4.D-4: In the event that human remains are discovered during grading and <br /> construction of development facilities by the Housing Element, work shall stop <br /> immediately. There shall be no disposition of such human remains, other than in <br /> accordance with the procedures and requirements set forth in California Health <br /> and Safety Code Section 7050.5 and Public Resources Section 5097.98. These <br /> code provisions require notification of the County Coroner and the Native <br /> American Heritage Commission, who in turn must notify the persons believed to <br /> be most likely descended from the deceased Native American for appropriate <br /> disposition of the remains. <br /> Site(s) affected: All <br /> (Draft SEIR, 4.D-19 to 4.D-20.) <br /> Impact 4.D-5 <br /> Development facilitated by the General Plan Amendment and rezonings, in <br /> combination with past, present, existing, approved, pending, and reasonably foreseeable future <br /> development that would adversely affect historical resources on or adjacent to cumulative <br /> project sites, could form a significant cumulative impact to historical resources. <br /> The SEIR evaluates the impacts of the proposed project regarding the potential <br /> for past, present, existing, approved, pending, and reasonably foreseeable future development <br /> to adversely affect historical resources on or adjacent to cumulative project sites. <br /> Significance Before Mitigation: Significant <br /> Significance After Mitigation: Less than Significant <br /> Finding: Changes or alterations have been required in or incorporated into the <br /> Project that would avoid or substantially lessen the significant environmental <br /> effect as identified in the SEIR. Mitigation Measure 4.D-5, which has been <br /> required in or incorporated into the Project, will reduce the significant <br /> environmental impact to a less than significant level. <br /> Facts in Support of Finding: The following facts and mitigation measures indicate <br /> that the impact will be reduced to less than significant. <br /> 1. For CEQA purposes, it is conservatively assumed that <br /> development facilitated by the proposed Housing Element could result in the <br /> demolition of historical resources. Other past, present, existing, approved, <br /> pending, and reasonably foreseeable future projects in the City that have, or will <br /> have, resulted in the demolition of historical resources could combine with the <br /> Housing Element projects to form a significant cumulative impact to historical <br /> resources. <br />
