had occurred in November 2012 with one of the massage technicians and an <br /> administrative citation was issued to the technician for a violation of the Pleasanton <br /> Municipal Code. Commissioner Blank then asked if the citation was a misdemeanor; to <br /> which Assistant City Attorney Larissa Seto stated that with the issuance of an <br /> administrative citation, the technician was entitled to a due process and appealed the <br /> administrative citation. In this instance, the technician's appeal was denied and her <br /> license was revoked and she is no longer allowed to provide massage services in the City <br /> of Pleasanton. However, the massage establishment can remain in business. The <br /> applicant's current landlord then spoke on the applicant's behalf and commented on her <br /> good standing with them at her current location. After considering all public comments, <br /> the Commission unanimously recommended approval of PUD-84-04-07M. <br /> DISCUSSION <br /> Operation of massage establishments is regulated by Chapter 6.24 (Massage) of the <br /> Pleasanton Municipal Code (PMC). Some of the key requirements of Chapter 6.24 are as <br /> follows: <br /> • Obtaining a permit from the Pleasanton Police Department, followed by zoning <br /> approval from the Planning Division, is required for massage technicians and <br /> establishments prior to working at or operation of a massage establishment. <br /> • Hours of operation are limited to 7:00 a.m. to 10:00 p.m. <br /> • No massage establishment shall posses, serve, keep, consume, etc. alcohol in the <br /> massage establishment. <br /> • Renewal from the Pleasanton Police Department is required every two-years. <br /> • Each massage technician is required to possess an original diploma, original <br /> certificate of graduation, or other written proof, including but not limited to course <br /> outlines and certified sealed transcripts, acceptable to the police chief, from a <br /> school or schools of massage, college, junior college, or university which shows <br /> satisfactory completion of at least 500 hours of a non-repetitive curriculum, and <br /> • Each applicant for a massage establishment permit who signs a declaration under <br /> penalty of perjury that such applicant shall not personally engage in the practice of <br /> massage is exempt from the educational requirements set forth in this section. <br /> (Ord. 1970 § 1, 2008) <br /> Chapter 6.24 in its entirety can be found in Attachment 2, Exhibit C. <br /> Zoning <br /> Massage establishments are referenced in Title 18 (Zoning) of the PMC to ensure that the <br /> location of a proposed massage establishment is consistent with the zoning and land use <br /> regulations.
