ARTICLE 13. PUD Planned Unit Development District. <br /> <br />cedure for revision of a preliminary development plan shall be fol- <br />lowed. If the final development plan conforms, a hearing shall be <br />set and notice given as prescribed in Sec. 1.109, (Public Hearing <br />Time and Notice), for City Planning Commission consideration of an <br />amendment changing the district boundaries to conform with the <br />final development plan. The Zoning Administrator shall review the <br />final development plan an.d shall prepare a report thereon which <br />shall be submitted to the Commission and to the applicant prior to <br />the hearing and the meeting at which the plan is to be considered. <br /> <br />S~e. 13.119. City Planning Commission Action. <br />At the public hearing the City Planning Commission shall review <br />the final ~levelopment plan and shall receive pertinent evidence <br />concerning the proposed zoning. At the same meeting, following <br />the public hearing, the Commission shall consider the tentative <br />subdivision map, if any, and shall consider all aspects of the final <br />development plan subject to regulation by this ordinance including <br />design review as prescribed in Artlele 18, with the Commission sit- <br />ting as the Board of Design Review. The Commission shall make a <br />specific finding as to whether the zoning map amendment is con- <br />sistent with the objectives prescribed in Sec. 1.101, (Objectives), <br />an.d the purposes prescribed in See. 13.160, (Purposes), and also <br />shall determine whether other aspects of the final development <br />plan regulated by this ordinance meet the objectives and purposes. <br />Within 40 days after the final developmont plan was filed, the <br />Commission shall approve, conditionally approve, or disapprove the <br />plan, and shall report to the Council its recommendation or deci- <br />sion on all aspects of the PUD regulated by this ordinance and the <br />Subdivision Ordinance. <br /> <br />Sec. 13.120. City Council Action. <br />Except when a plan disapproved by the City Planning Commission <br />is withdrawn by the applicant, the City Council shall hold a public <br />hearing on the proposed amendment to the ~oning map in accord <br />with the provisions of Article 28, (Amendments). The hearing shall <br />be set and notice given as prescribed in Sec. 1.109, (Public Hearing <br />Time and Notice). At the same meeting, following the pub]lc hear- <br />lng, the Council shall consider all aspects of the PUD regulated <br />by this ordinance that it may wish to consider or that may be <br />brought before it by the applicant or the Commission. Within 40 <br />days following the closing of the hearing the Council shall make <br />a specific finding as to whether the zoning map amendment is <br />consistent with the objectives prescribed in Sec. 1.101, (Objectives), <br /> <br />and the purposes prescribed in Sec. 13.100, (Purposes), and s~ <br />also determine whether other aspects of the final developm <br />plan regulated by this ordinance meet the objectives and purpo~ <br />If the Council fin'ds that the final development plan is consist <br />with the objectives and purposes, it shall approve the plan ~ <br />shall enact an ordinance amending the zoning map subject to c~ <br />pliance with specified conditions.
