1 DECLARATION OF ANNE FOX <br /> 2 I, Anne Fox, hereby declare as follows: <br /> 3 1. I am now and was at all times referenced in this declaration a resident of Pleasanton. I <br /> 4 have personal knowledge of the facts contained in this declaration and would be competent to <br /> 5 testify as to them if called as a witness. <br /> 6 2. I was one of the authors of Measure PP. the Save Pleasanton Hills & Housing Cap <br /> 7 Initiative, which was approved by Pleasanton voters in November 2008. I also signed the ballot <br /> 8 arguments in favor of Measure PP that was published in the voter pamphlet. <br /> 3. The initiative arose out of frustration that I and other Pleasanton residents were feeling <br /> 9 <br /> about the resistance of Pleasanton City staff, and particularly planning staff, to instituting <br /> 10 <br /> regulation of development in the Pleasanton Hills. <br /> 11 <br /> 4. During 2004, I was one of the Planning Commissioners who voted to place an interim <br /> 12 moratorium on approving large scale housing developments including Lund Ranch II and <br /> 13 Kottinger Hills/Oak Grove prior to the completion of the General Plan so that ridgeline and <br /> 14 hillside development regulations could be developed. The city council rejected the interim <br /> 15 moratorium. <br /> 16 5. During 2005 and 2006, as planning commissioners, I, along with Mary Roberts, Brian <br /> 17 Arkin, and Phil Blank, attempted to get the City to consider placing restrictions on hillside <br /> 18 development, and particular development on slopes of over 25%, in the general plan. City staff <br /> 19 would not agendize these issues for discussion by the full commission. <br /> 20 6. City staff never revealed to me that there was a pre-existing Hillside Ordinance(Chapter <br /> 21 18.76 Hillside Planned Development District) adopted in 1975 that provides development <br /> 22 standards specifically designed for hillside development. The stated purpose includes"... in order to <br /> retain the significant natural features of the hill areas, densities will diminish as the slope of the <br /> 23 <br /> terrain increases" and "To preserve the predominant views both from and of the hill areas and to <br /> 24 <br /> retain the sense of identity and imageability that these hill areas now impart to the city and its <br /> 25 <br /> environs."
