The terms for the affordable housing proposed by applicant shall be reviewed by the <br /> Housing Commission which shall make a recommendation to the City Council whether to <br /> accept, reject, or modify the terms. As a condition of approval, the City Council may <br /> require that terms of affordability be included in an Affordable Housing Agreement. <br /> 10. The project shall meet all requirements of the City's Growth Management Ordinance, as <br /> described in a Growth Management Agreement for the project and the project <br /> Development Agreement. <br /> 11. Prior to issuance of a building permit, the applicant/developer shall submit a phasing plan <br /> for the project subject to the review and approval by the Director of Community <br /> Development. The phasing plan shall include plans/details showing that adequate parking <br /> will be maintained for the existing office uses on the subject property during the <br /> construction of the residential and retail portions of the project. <br /> 12. The applicant shall locate the pedestrian pathway to be used by the California Center <br /> office employees farther away from the tot lot subject to the satisfaction of the Director of <br /> Community Development. <br /> 13. The applicant shall install a parcourse around the California Center site, subject to the <br /> satisfaction of the Director of Community Development. <br /> 14. Details and location of the wood screen wall shown on Sheet A5-1 of the development <br /> plans shall be submitted in conjunction with the plans submitted for issuance of building <br /> permits and shall be subject to the review and approval by the Director of Community <br /> Development prior to issuance of building permits for the project. <br /> 15. The carport colors shall be subject to the review and approval by the Director of <br /> Community Development prior to painting. The carport colors shall match and/or <br /> complement the apartment building colors. <br /> 16. Prior to occupancy, the applicant/developer shall install a pedestrian gate within the <br /> existing fencing at either end of Tassajara Creek on Rosewood Drive and Owens Drive. <br /> In addition, the applicant/developer shall provide trail connections between the existing <br /> Zone 7 gravel access road along the west side of Tassajara Creek and the two trail <br /> connections on the CA Center property. Details of said improvements shall be shown on <br /> the plans submitted for issuance and shall be subject to the review and approval by the <br /> Director of Community Development prior to issuance of building permits for the project. <br /> 17. The parking/storing of boats, campers, recreational vehicles, and/or trailers on site or in <br /> any parking space (i.e., carport, garage, or uncovered space) shall be prohibited. The <br /> garages shall not be modified or used for storage in a manner that would interfere with <br /> the ability to park cars within the garage. In addition, the storage of materials in the <br /> carports or uncovered parking spaces shall be prohibited. The applicant/property <br /> manager shall be responsible for enforcing these restrictions, which shall be stated <br /> clearly in all leases. <br /> 3 of 30 <br />
