The PUD development plan and major modification shall expire two years from the <br /> effective date of this ordinance or later as approved by a development agreement unless <br /> a building permit is issued and construction has commenced and is diligently pursued. In <br /> the event of a conflict between any of these PUD conditions of approval and a <br /> development agreement for the project, the terms and conditions of the project <br /> development agreement shall govern. <br /> 3. The applicant shall execute the development agreement within 10 days of the City <br /> Council's second reading of the ordinance approving the development agreement. <br /> 4. The project developer shall pay any and all fees to which the property may be subject <br /> prior to issuance of permits or as provided for in a development agreement. The type and <br /> amount of the fees shall be those in effect at the time the permit is issued unless <br /> otherwise provided in a development agreement covering the project. <br /> 5. Prior to issuance of a building permit, the applicant/developer shall pay the applicable <br /> Zone 7 and City connection fees and water meter cost for any water meters, including <br /> irrigation meters, applicable to the portion or phase of the project covered by the permit. <br /> Additionally, the developer shall pay any applicable Dublin-San Ramon Services District <br /> (DSRSD) sewer permit fee. <br /> 6. Prior to issuance of a building permit, the applicant/developer shall pay the applicable <br /> City and Tri-Valley regional traffic impact fees for the project as determined by the City <br /> Traffic Engineer, or as identified in a project development agreement. <br /> 7. The applicant/developer shall pay the applicable in-lieu park dedication fees. <br /> 8. This approval does not guarantee the availability of sufficient water capacity to serve the <br /> project. Prior to the recordation of a Final Map, issuance of a grading permit, issuance of <br /> a building permit, or utility extension approval to the site, whichever is sooner, the <br /> applicant/developer shall submit written verification from Zone 7 Water Agency or the City <br /> 2 of 30 <br />
