Ordinance No. 846 <br /> Page Two. ~ <br /> <br /> Sec. 5-1.62 Designation of Equestrian Trails. The <br /> Planning Commission shall advise the City Council <br /> on any proposals for equestrian trail designa- <br /> tions. The City Council shall consider the <br /> designation of equestrian crossings as provided <br /> for in California Vehicle Code Section 21805 <br /> whenever any proposed equestrian trail would <br /> - cross a highway. <br /> <br /> Sec. 5-1.63 Prohibited Areas. <br /> <br /> a. Commercial Centers. No horse shall be <br /> ridden, walked or tethered on the streets, <br /> sidewalks, walkways or parking lots of any <br /> shopping center of the City of Pleasanton <br /> or along Main Street in the City of Pleasan- <br /> ton, except on approved equestrian trails <br /> or crossings. <br /> <br /> b. Other Prohibited Areas. The City Council <br /> may, from time to time, designate by resolu- <br /> tion, any other areas of the City prohibited <br /> to horse traffic. The City shall post all <br /> such additional areas, but posting shall <br /> not be a prerequisite for citing violators. <br /> <br /> c. Exception. Nothing in this article shall <br /> prohibit the participation of mounted or <br /> equestrian units in parades authorized by <br /> the City Council. Walking of horses enroute <br /> to a licensed veterinarian is not prohibited <br /> by this article. <br /> <br /> Sec. 5-.1.64 Penalties. Notwithstanding any other <br /> provision of thls code, the first violation <br /> of any provision of this article shall con- <br /> stitute an infraction. <br /> <br />Section 2. If any section, subsection, sentence, clause or phrase of <br /> this ordinance is for any reason held by court of competent <br /> jurisdiction to be invalid, such a decision shall not affect <br /> the validity of the remaining portions of this ordinance. <br /> The City Council of the City of Pleasanton hereby declares <br /> that it would have passed this ordinance and each section, <br /> subsection, sentence, clause or phrase thereof, irrespective <br /> of the fact any one or more sections, subsections, sentences, <br /> clauses or phrases be declared invalid. <br /> <br />Section 3. This ordinance shall become effective thirty (30) days after the date of its final passage and adoption. <br /> <br />Section 4. This ordinance shall be published once within fifteen <br /> (15) days after its adoption in "THE TIMES," a nespaper <br /> of general circulation, published in the City of Pleasanton, <br /> and shall become effective thirty days after its final <br /> passage and adoption. <br /> <br /> <br />
