Minor changes to
the plans may be allowed subject to the approval of the Planning Director if found to be
in substantial conformance to the approved exhibits.

The applicant shall obtain a building permit from the Building and Safety Division prior
to the commencement of any construction. The building developer shall pay any and all
fees to which the property may be subject prior to issuance of building permits.

This design review approval will lapse and shall be void within one year following the
effective date of the project approval, unless a building permit is issued or an extension
has been approved by the City.

The building permit plan check materials will be accepted for submittal only after com-
pletion of the 15 day appeal period, unless the project developer submits a signed state-
ment acknowledging that the plan check fees may be forfeited in the event that the ap-
proval is overturned on appeal, or that the design is significantly changed as a result of
the appeal. In no case will a building permit be issued prior to the expiration of the 15
day time-period.

The colors and materials of the proposed addition shall match those of the existing struc-
ture.

If the applicant chooses to eliminate the basement from this project, the floor area pres-
ently shown as the staircase may be converted to floor area for the family room.

The applicant shall remove a four foot wide strip of concrete from the south side of the
site. Its length shall be 47 feet beginning at the existing gate. In this area, the applicant
shall install the trees shown in Exhibit "C" covered by this approval. A tree planting plan
for this area shall be part of the building permit plan set. The trees shall be installed prior
to the final inspection by the Planning Department. All other landscaping may be in-
stalled within nine months of occupancy. The applicant shall enter into an agreement
with the City, approved by the City Attorney, which guarantees that these will be main-
tained in a manner consistent with this approval. This agreement shall be recorded
against the property as a restrictive covenant before issuance of a building permit.

PADR-729 (PAP-52) Final Conditions of Approval Page 1 of 2
