He suggested that, if the <br /> Commission wishes, the phrase "or as otherwise approved by the Director of <br /> Community Development' could be added to the conditions, as written, and the <br /> Commission would not need to go through the details of the conditions. <br /> Mr. lnderbitzen indicated this would be fine and that they could work it out between now <br /> and when it goes before the City Council. <br /> Commissioner Pearce thanked Mr. Dolan and asked if he is suggesting this simply for <br /> Condition No. 88 or for Conditions Nos. 55 and 40 as well. <br /> Mr. Dolan replied that it would be for all the conditions. <br /> Commissioner Pearce inquired if that would also include the PUSD condition. <br /> Mr. Dolan noted that Mr. lnderbitzen made a specific suggestion that this condition be <br /> ultimately replaced by the agreement and that staff does not oppose that as part of the <br /> Commission's recommendation. He added that if the applicant has an agreement with <br /> PUSD, the condition would be moot. <br /> Chair Blank stated that he assumes if there is no agreement, legal staff will figure out <br /> whether or not that condition should be there, considering that it cannot be there illegally <br /> as Mr. lnderbitzen is suggesting. <br /> Mr. Dolan replied that is correct. <br /> Commissioner Posson noted that Condition No. 60 talks about allowing the future <br /> installation of photovoltaic (PV) and solar water heating systems, adding that the <br /> apartment buildings are going to be wired in order to meet Title 24 requirements. He <br /> inquired why the solar panels not be installed now. <br /> Todd Regonini, Sares Regis Group, Project Manager for this development community, <br /> stated that the project will have to comply with the Green Points checklist, and an initial <br /> run-through with that checklist shows that the project is approaching 100 points, far in <br /> excess of the minimum that is required; therefore, there is no actual need to put the <br /> PV's in right now from the standpoint of sustainability standards.
