Chapter 13.08 — Parks and Recreation Facilities <br /> PMC 13.08.020 (Definitions), Subsections B. and E., amend the definitions to reflect <br /> change in name of department. <br /> PMC 13.08.090 (Sale of goods — Exhibitions) currently prohibits the sale of goods and <br /> entertainment in public parks unless approved by the Director of Community Services. <br /> The proposed change to §13.08.090 would additionally prohibit private lessons or <br /> classes for compensation in public parks. The proposed change is recommended <br /> because instructors and participants of such private classes not affiliated with the City <br /> have been interfering with other residents' use of the public parks, as well as disturbing <br /> neighbors. <br /> PMC 13.08.150 (Motor driven cycles and model vehicles and planes) has a list of items <br /> which are not allowed in public parks. The proposed amendment would expand the list <br /> to also include motorized bicycles and mopeds, as well as give the Chief of Police <br /> discretion to determine if other motorized transportation are subject to the prohibition <br /> even if not specifically defined in the California Vehicle Code. <br /> Chapter 18.116 Temporary Uses & Chapter 18.124 Conditional Uses <br /> Amend PMC 18.116.040 (Temporary outdoor uses) and PMC 18.124.1701 (Temporary <br /> use permit) to memorialize current City practices which allow limited duration outdoor <br /> activities (e.g. plant sales at mall parking lot, car sales at credit union parking lots, etc.) <br /> in more zoning districts, subject to City permit. <br /> Chapter 18.124 Conditional Uses <br /> The process for suspension or revocation of a conditional use permit in §18.124.130 <br /> would be amended to provide for a hearing prior to such action as legal precedent <br /> requires. <br /> Chapter 19.40 Improvements <br /> The proposed amendment to Title 19 (Subdivisions) would memorialize State law <br /> (California Government Code §§ 66485 et seq) and City practice by adding a new <br /> §19.40.060 (Supplemental size and reimbursement) to provide clear authority for the <br /> City to require developers to oversize improvements to serve other properties and <br /> receive reimbursement for such extra capacity. <br /> Resolution Amending Master Fee Schedule <br /> The proposed resolution to amend the Master Fee Schedule would clearly state that the <br /> penalties for administrative citations currently set forth in PMC 1 .12.020 (e.g. $100 for <br /> 1s1 violation; $200 for 2nd violation etc.) apply to violations cited pursuant to the authority <br /> in PMC 1.24.040 (Amount of Fines).
