BACKGROUND <br /> The omnibus ordinance and resolution amending the Pleasanton Municipal Code (PMC) <br /> and Master Fee Schedule is an annual process to propose minor, non-controversial <br /> changes to make them current with new State laws, current City policies and <br /> department names, as well as correct minor errors. <br /> DISCUSSION <br /> The proposed omnibus ordinance and related resolution address the following: <br /> Chapter 1 .12 General Provisions <br /> With the City Council's consideration on April 2nd of a prohibition on expanded <br /> polystyrene foodservice ware, Section 1 .12.020.B. would be amended to include <br /> violations of that prohibition (Chapter 9.10) punishable as an infraction. <br /> Chapter 1 .20 Campaign Reform <br /> With new State law (AB 2452) adopted in 2012, campaign statements can be filed <br /> completely electronically. The proposed amendment to §1.20.030.B. would delete the <br /> 2008 requirement for both paper and electronic statements, and only retain the <br /> electronic filing requirement. <br /> The proposed ordinance also makes required findings about secure and effective <br /> electronic filing system operations. <br /> Chapter 2.29 Youth Commission <br /> Amend PMC 2.29.030 (Membership; appointments) to remove the requirement that <br /> commissioners attend specific schools. The change is recommended because prior <br /> recruitments had resulted in youth willing to serve, but no available space for their <br /> specific school. Simultaneously, some schools did not have sufficient interest and seats <br /> had to remain vacant. <br /> It is also proposed to amend PMC 2.29.080 (Meetings) to have meeting dates coincide <br /> with the school year, rather than year round. <br /> Both modifications were recommended by the Youth Commission at its November 14, <br /> 2012 meeting. <br /> Chapter 5.08 License Applications, Renewals and Conditions <br /> PMC 5.08.040 (Statement and Records), Subsection B., would be amended to allow the <br /> applicant or licensee to first provide a written statement to confirm information on its <br /> application, and thereafter may the City require a verification by an accountant or other <br /> business agent. The current code only provides for an accountant verification. <br /> PMC 5.08.110 (Posting) has an inadvertent duplication of Subsections B. and C. The <br /> proposed modification would delete the duplicate Subsection C, and amend the <br /> language to allow the business operator to use either the original or a photocopy of its <br /> business license to meet the posting requirement. <br /> Page 2 of 4 <br />
