2. Neighborhood Park/Detention Basin Funding and Improvement Agreement. <br /> All projects shall be developed in accordance with the Neighborhood <br /> Park/Detention Basin Funding and Improvement Agreement. <br /> 3. Cost-Sharing and Pre-Development and Cooperation Agreements. All projects <br /> shall be developed in accordance with the Cost-Sharing and Pre-Development and <br /> Cooperation Agreements. <br /> a. El Charro Road Improvements. As required by and subject to the Pre- <br /> Development and Cooperation Agreement if the improvements to El Charro <br /> Road are not already completed by the City of Livermore for the El Charro <br /> Specific Plan development, the ACSPA shall construct these improvements <br /> as part of any first phase of Staples Ranch development. Any such roadway <br /> and flood control improvements shall be constructed so as to comply with all <br /> applicable provisions of the Cooperation Agreement, including but not limited <br /> to Section 3.2 thereof. <br /> b. 1-580 Off Ramp Improvements. The City of Pleasanton shall make <br /> improvements to the 1-580 El Charro Road eastbound off ramp as stipulated in <br /> the Cost-Sharing Agreement if these improvements have not been constructed <br /> by the City of Livermore. <br /> II.D. Code, General Plan, and Permits <br /> 1. Attention Getting Devices. At no time shall balloons, banners, pennants, or other <br /> attention getting devices be utilized on the site except as allowed by <br /> Section 18.96.060.K of the Zoning Ordinance for grand openings or by Section <br /> 18.116.040 of the Zoning Ordinance if approved as part of a temporary conditional <br /> use permit. At no time shall spot lighting be used in conjunction with such grand <br /> openings and/or promotional events. <br /> 2. Grand Openings. Temporary signs, banners, pennants, and decorations shall be <br /> allowed subject to the requirements of Section 18.96.060.K of the Pleasanton <br /> Municipal Code. <br /> 3. Noise. Except as otherwise modified by the conditions of approval for this case, <br /> compliance with the City's noise standards shall be achieved. <br /> 4. Airport Protection Area Boundary. Dwelling units shall not be located east of <br /> the Airport Protection Area (APA) line for the Livermore Municipal Airport adopted <br /> by the Alameda County Airport Land Use Commission in 1963. Prior to the <br /> issuance of a building permit, the project developer shall revise the plans and draw <br /> the APA line on the site plan. <br /> 5. Del Valle Dam Evacuation System. Prior to occupancy, the property owner shall <br /> meet with the Fire Marshal, or his or her designee, about the Del Valle Dam <br /> evacuation system, in the event of flooding.
