BACKGROUND <br /> The Vineyard Villa Mobile Home Park is a 208-unit mobile home park located at 3263 <br /> Vineyard Avenue in which residents own their own mobile homes but not the land upon <br /> which the mobile homes are located. The land is owned by the park owner, Pleasanton <br /> Mobile Home Park, LP. <br /> Tract 8062 is a map for a condominium conversion which would convert the existing <br /> mobile home park from rental spaces to spaces which can be purchased. On March 2, <br /> 2010, City Council approved the tentative map along with a settlement agreement with <br /> Pleasanton Mobile Home Park, LP. As part of the settlement agreement, the actual <br /> condominium conversion will not be effective any earlier than January 1, 2020. The filing <br /> of this map secures the owner's right to convert this park to a condominium project, <br /> subject to the terms of the settlement agreement. <br /> The Engineering staff, Planning staff, and City Attorney's Office have reviewed the Final <br /> Map and found it to be in substantial conformance with the approved tentative map. <br /> DISCUSSION <br /> Vineyard Avenue Right-of-Way <br /> The Vineyard Avenue street frontage along this parcel is currently owned in fee by the <br /> Park owner with a Public Highway and Utility easement over the road. This is typical of <br /> older areas where properties went to the centerline of the road. As part of the final map, <br /> this portion of Vineyard Avenue will be dedicated to the City for roadway purposes. <br /> Discretion to Deny the Final Map <br /> The conversion of rental mobile home parks to residential ownership is governed by the <br /> Subdivision Map Act. The approval of a Final Map, when it substantially complies with <br /> the conditions of the tentative Map, is a mandatory, ministerial act (Government Code, <br /> Section 66474.1). A Final Map shall be disapproved only for failure to meet conditions <br /> that were applicable at the time the Tentative Map was approved. If the Final Map is <br /> disapproved, there must be a finding identifying the conditions which were not met <br /> (Government Code, section 66473). <br /> Staff has reviewed the conditions of approval of the Tentative Map, and finds that all <br /> have been satisfied and that the Final Map complies with the conditions of the Tentative <br /> Map.I rian y: Approve by: <br /> rian Dolan Nelson Fialho <br /> Director of City Manager <br /> Community Development <br /> Attachments: <br /> 1.
