CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, ALAMEDA <br /> <br /> ORDINANCE NO. 1886 <br /> <br />AN ORDINANCE AMENDING SECTIONS 19.44.040(B)(1) and 19.44.120 <br />OF THE PLEASANTON MUNICIPAL CODE WAIVING THE IN-LIEU <br />PARK DEDICATION FEES FOR SECOND UNITS, NURSING HOMES, <br />AND SENIOR CARE/ASSISTED LIVING FACILITIES <br /> <br />WHEREAS, <br /> <br />at its meeting on May 8, 2003, the Parks and Recreation Commission <br />recommended that the City Council amend the Pleasanton Municipal Code to <br />waive the in-lieu park dedication fees for second units, nursing homes, and senior <br />care/assisted living facilities; and; <br /> <br />WHEREAS, <br /> <br />at its meeting on June 4, 2003, the City Council reviewed the report of the City <br />Attomey and the Director of Parks and Community Services (SR 03:148) <br />regarding amendments to Chapter 18.106, "Second Units," of the Pleasanton <br />Municipal Code and the recommendation of the Parks and Recreation <br />Commission; now, therefore, <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1: <br /> <br />Section 2: <br /> <br /> The City Council makes the following fmdings: <br /> <br />A. Waiving in-lieu park dedication fees for second units is consistent with the <br /> State's policy to consider second units as density neutral and to increase in- <br /> fill development to address the statewide housing shortage. <br /> <br />B. Waiving in-lieu park dedication fees for second units, nursing homes, and <br /> senior care/assisted living facilities furthers Policies 10 and 48 in the City's <br /> Housing Element of its General Plan. <br /> <br />C. Adopting this ordinance to waive in-lieu park dedication fees is exempt <br /> from the California Environmental Quality Act pursuant to section <br /> 21080(b)(8) of the Public Resources Code. <br /> <br /> Section 19.44.040(B)(1) of the Pleasanton Municipal Code is amended to read as <br /> follows: <br /> <br />a. "Single-family dwelling unit" shall mean: <br /> <br /> <br />
