CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1007 <br /> <br /> APPROVING THE APPLICATION OF SOUTHERN PACIFIC <br /> TRANSPORTATION COMPANY FOR DEVELOPMENT PLAN APPROVAL <br /> FOR APPROXIMATELY 70,000 SQ. FT. OF FLOOR AREA ON <br /> APPROXIMATELY 4.6 ACRES DOWNTOWN AND REZONING THE <br /> SITE TO pUD-COMMERCIAL/OFFICES AND REZONING THE <br /> WAYSIDE AND DELUCCHI PARKS TO PUD-OPEN SPACE, PARKS <br /> AND RECREATION <br /> <br />WHEREAS, Southern Pacific Transportation Company applied for <br /> development plan approval for construction of an <br /> approximately 70,000 sq. ft. commercial/office develop- <br /> ment to be located between First Street and the Southern <br /> Pacific railroad right-of-way from Angela Street to the <br /> extension of Bernal Avenue and between Neal Street, <br /> Angela Street, the Southern Pacific railroad right- <br /> of-way and a line approximately 250 feet east of Main <br /> Street, and rezoning of the site to pUD-Commercial/ <br /> Offices, also to rezone the Delucchi and Wayside Parks <br /> located on the west side of First Street between Angela <br /> Street and a point approximately 350 feet north of Neal <br /> Street from C-C (Central Commercial) to PUD (Planned <br /> Unit Development-Open Space, Parks and Recreation); and <br /> WHEREAS, based on the Initial Environmental Study, a mitigated <br /> negative declaration was adopted by Council on <br /> November 24, 1981; and <br /> <br /> WHEREAS, Council received the Planning Commission's recommenda- <br /> tion for approval of the development plan and rezoning; <br /> and <br /> <br /> WHEREAS, a duly noticed public hearing was held on November 24, <br /> 1981; and <br /> WHEREAS, the City Council finds that this development plan is <br /> consistent with the General Plan policies of the City <br /> of Pleasanton. <br /> THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br /> FOLLOWS: <br /> Section 1: Approves the development plan for construction of an <br /> approximately 70,000 sq. ft. commercial/office develop- <br /> ment to be located between First Street and the Southern <br /> Pacific railroad tracks from Angela Street to Bernal <br /> Avenue extension and on the Southern Pacific depot <br /> property (pUD-81-28), subject to the conditions on <br /> Exhibit "A" attached hereto and by this reference <br /> incorporated herein. <br /> <br /> <br />
