6. Actions of the Zoning Administrator and Planning Commission <br /> 7. Approved the Final Map, Improvement Plans and Subdivision Agreement for Tract 8103 (Village <br /> at Ironwood-Final Phase); accepted all easements offered for dedication on the Final Map, and <br /> authorized the City Manager to execute said Subdivision Agreement and a Deed granting a storm <br /> drain easement to Zone 7 across the public trail <br /> 8. Accepted public improvements performed by O'Grady Paving, Inc. for the Pavement <br /> Rehabilitation of Various City Streets project, CIP No. 105036/Federal Project No. STPL- <br /> 5101(025); authorized the City Clerk to file a Notice of Completion, payment of retention in the <br /> amount of $63,269.05, and the transfer remaining budget $303,968 to the 2011-12 Gas Tax Fund <br /> Balance after all of the CMA Block Grant Funding reimbursements have been received <br /> 9. Accept public improvement performed by Valley Slurry Seal Co. for the Annual Slurry Seal of <br /> Various City Streets project, CIP No. 105004; authorized the City Clerk to a file Notice of <br /> Completion, payment of retention in the amount of $19,772.68, and the transfer of $59,045 in <br /> remaining funds to the Measure B Fund Balance <br /> 10. Approved the Final Map, Improvement Plans and Subdivision Agreement for Tract 8112 (The <br /> Reserve at Pleasanton); authorized the City Manager to execute said agreement and any <br /> necessary Quit Claim Deeds to effectuate the abandonment of unneeded right of way to the Toll <br /> Brothers; accepted all street right of way dedications in fee on the Final Map and all easements <br /> offered for dedication on the Final Map; and deferred action on the Reimbursement Agreement <br /> with Toll Brothers for the extension of the water main and sanitary sewer main within Parcel C <br /> Mayor Hosterman opened the public hearing. <br /> Mary Roberts said she had significant concerns related to the subdivision's proposed maintenance <br /> agreement, though acnowledged that is not on the agenda at this time. She also had concerns with the <br /> reimbursement agreement for the extension of water and sewer service and the fact that she is being <br /> required to reimburse the Toll Brothers to bring water and sewer lines up to Old Vineyard Road for <br /> future development of her property. <br /> Mayor Hosterman explained that by law, the Council must approve the Final Map and all associated <br /> documents but asked if Ms. Roberts would support bifurcating the reimbursement agreement in order to <br /> allow for further discussion. Ms. Roberts said that would be acceptable. <br /> Councilmember McGovern said she is hesitant to approve an agreement that asks one person on the <br /> Vineyard corridor (Ms. Roberts) to do something that no one else is being asked to do. She asked and <br /> Mr. Fialho confirmed that the Tentative Map supports the property owner/developer extending sewer <br /> and water service to Old Vineyard to support future development. She asked if this requires acceptance <br /> of a reimbursement agreement. <br /> Mr. Fialho explained that the Government Code allows the City to request a reimbursement. He said it <br /> is common that when development occurs downstream from another potential development site, the <br /> owner of the latter is asked to reimburse the developer for improvements that to support their own <br /> eventual development. In this instance, the City has asked that the developer extend these <br /> improvements down Old Vineyard and that the Roberts' potential three properties bear a total cost of <br /> about $38,000. If there is not consensus on the reimbursement agreement as proposed, the Council <br /> may approve the Final Map and all associated documents and withhold action on the reimbursement <br /> agreement until such time as there is support from the two property owners. <br /> Councilmember McGovern said she could support that option. <br /> City Council Minutes Page 2 of 7 July 17, 2012 <br />
