Box 520 Pleasanton, CA 94566 Recording requested Pursuant to Government Code Sections 27383&6103 PREANNEXATION AND PROVISION OF WATER AND SEWERAGE FACILITIES AND SERVICE AGREEMENT THIS AGREEMENT is made this day of_, 2012 between the City of Pleasanton, a municipal corporation (City) and Steve and Darlene Mix (Owners). RECITALS A. Owners are the owners of certain real property located at 6360 Alisal Street (APN 949-0015-005-01), Pleasanton, CA, more particularly described in Exhibit A (the Exhibit A property) and incorporated herein by reference. B. Owners wish to connect the Exhibit A property to the City sewer. C. Owners wish to connect the Exhibit A property to the City water system. D. Generally, City policy requires property to be annexed prior to extending such City services as water and sewer service. E. Owners are willing to annex the Exhibit A property either as part of a larger annexation or as part of a smaller annexation involving properties and other property contiguous to the City. F. The public health, safety, and welfare of the City's residents are well served by eliminating the need for water wells and septic tanks and by connecting to the City's water and sewer system. G. City is willing to extend its sewer and water services only if there are assurances that the properties won't be further subdivided without approval of the City. NOW, THEREFORE, City and Owners hereby agree as follows: 1. Sewer and Water Service. Owners may connect to City's sewer and water systems prior to the City's annexation of the properties upon the satisfaction of the following conditions: (a) Owners shall pay the then-existing sewer and water connection fees for connecting to the City sewer and water system in accordance with applicable City ordinances and master fee schedules.
