CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 982 <br /> <br /> AN ORDINANCE APPROVING A tlILLSIDE PLANNED <br /> DEVELOPMENT PERMIT FOR CASTLEWOOD PROPERTIES, <br /> INC., CASE PUD(HPD)-80-12 <br /> <br /> WHEREAS, Castlewood Properties, Inc. has applied for development <br /> plan approval for a Hillside Planned Development for <br /> the approximately 48 acre site located on the west side <br /> of Foothill Road, just north of Bernal Avenue for a <br /> 24-1ot, 25,000 sq. ft. minimum lot size, single-family <br /> residential development; and <br /> <br /> WHEREAS, the property is zoned t~D (Hillside Planned Development) <br /> District; and <br /> <br /> ~{EREAS, a mitigated negative declaration has been approved for <br /> case PUD(HPD)-80-12; and <br /> <br /> ~tEREAS, on May 27, 1981 a public hearing was held before the <br /> Planning Commission at which time all public testimony <br /> and documents were reviewed and a recommendation to <br />-- the City Council was made to approve a project containing <br /> 21 lots for the property; and <br /> <br /> ~tEREAS, the City Council held a public hearing on June 23, 1981, <br /> took testimony from the proponents and opponents of <br /> the project, and reviewed all recommendations, reports, <br /> and exhibits, including the environmental documents. <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON ORDAINS <br /> AS FOLLOWS: <br /> <br /> Section 1: Approves Case PUD(HPD)-80-12 for 23 lots subject to <br /> all conditions set forth in Exhibit I to this ordinance, <br /> attached hereto and by this reference incorporated herein. <br /> <br /> Section 2: Makes the following findings: <br /> <br /> a. That the approval of the plan is in the best <br /> interests of the public health, safety and general <br /> welfare. <br /> <br /> b. That off-site and on-site views of the ridges will <br /> not be substantially impaired in that seventy percent <br /> (70%) of the lots are not visible from the valley <br /> floor, that no dwelling is located atop a ridgeline, <br /> and that condition 4 requires that the view from <br />' the neighboring property not be interefered with. <br /> <br /> <br />
