Dottie Fink said Mr. Baker's, Mr. Pretzel's, Mr. Deike's and her own fence have been in significant <br /> disrepair for years, which should dispel any claims regarding concerns over privacy and security. She <br /> also noted that she was the first of the four to repair the adjoining fence line, which she constructed at 6 <br /> feet and assumed others would follow suit or else request a building permit. <br /> Councilmember Thorne asked if staff's proposed alternative satisfies the majority of the parties <br /> involved. Mr. Bocian said it addresses primarily Ms. Fink's request. Mr. Pretzel is still requesting that <br /> the entire fence be reduced to 6 feet in height. <br /> Councilmember McGovern requested and Mr. Dolan requested clarification on the timeline of events. <br /> Mayor Hosterman moved to approve the staff recommendation, with the addition that the entire length <br /> of fence be reduced to 6 feet in height to maintain the same look and feel as the rest of the <br /> neighborhood. <br /> Councilmember Sullivan seconded the motion. He said he visited the site and struggled with this <br /> considerably. He noted it is not uncommon for residents to build something not to code, apply for a <br /> permit, and receive approval after the fact. The issue is that while that person comes out whole, <br /> everyone else involved is impacted. <br /> Councilmember McGovern said it seemed the neighbors had an opportunity to confer and determine <br /> how their respective fences could best blend with one another. That this was not done is disheartening <br /> and she said she could support the motion. <br /> Councilmember Cook-Kallio said it is understandably difficult for the Council to attempt to mediate this <br /> sort of personal neighborhood dispute. She said she would favor a uniform fence height, at either 6 or 7 <br /> feet. <br /> Councilmember Thorne concurred. <br /> MOTION: It was m/s by Hosterman/Sullivan to waive full reading and adopt Resolution No. 12-540 to <br /> deny the appeal and uphold the decision of the Planning Commission, with the addition that the entire <br /> length of fence be reduced to 6 feet in height to maintain the same look and feel as the rest of the <br /> neighborhood. Motion carried by the following vote: <br /> Ayes: • Councilmembers Cook-Kallio, McGovern, Sullivan, Thorne, Mayor Hosterman <br /> Noes: None <br /> Absent: None <br /> 17. Authorize the City Manager to execute a contract with Alameda County to provide water and <br /> sewer maintenance services for the Castlewood Service Area for fiscal year 12-13 <br /> Director of Operation Services Smith presented the staff report. The Alameda County Public Works <br /> Department oversees and administers the Castlewood County Service Area's water and sewer <br /> systems. In February 2012, the County issued a Request for Proposals to operate and maintain the <br /> area and the Council authorized staff to submit a proposal for these services. <br /> Mr. Smith reviewed a map of the City's existing sewer and water service area, noting that the City <br /> currently provides certain types of service to several portions of the County and nearly all areas <br /> surrounding Castlewood. The City also has a history of contract work with the County on several <br /> relevant levels. He noted that the City has been approached numerous times about taking over the <br /> County's current system, but declined due to the poor condition of some of their larger assets. In <br /> pursuing this idea, City staff recommended that the County hire a consultant to evaluate its entire <br /> system and develop an improvement plan to bring it to a condition where the City would be willing to <br /> City Council Minutes Page 8 of 12 May 15, 2012 <br />
