something that the Council deemed appropriate. He said he could not support Option 1, would support
Option 2 as the closest thing to the original condition, and that he could go as far as Option 3 because it
still supports the intent for the skylight.
MOTION: It was m/ by Thorne to approve Option 1, as outlined in the staff report. Motion failed for lack
of a second.
Councilmember McGovern asked if the lone tree, as depicted in Mr. Person's photo, is what staff
envisioned with respect to the buffering landscape identified in the conditions of approval.
Mr. Dolan said "no," but also that this is not what the tree will look like once it has an opportunity to
establish itself and grow. The location and species of the tree were selected under the guidance of
Mike Fulford, who concluded that this type of tree at this location would satisfy the requirements. Since
the tree is still in the box and not growing like it would if planted, it is obviously not achieving anything
near what was intended.
MOTION: It was m/s by Sullivan/Hosterman to waive full reading and adopt Resolution No. 12-526 to
deny the appeal of Rodney & Trina Lopez to modify condition 8 of City council Resolution 11-420 and
to approve Option 3, increasing the payment to equal the lowest bid ($3,745) provided by the Perry's,
with payment provided to the Perry's after the skylight is installed and approved by the City's Building
Division. Motion carried by the following vote:
Ayes: Councilmembers Cook-Kallio, McGovern, Sullivan, Mayor Hosterman
Noes: Councilmember Thorne
Absent: None
MATTERS INITIATED BY COUNCIL
Councilmember McGovern said she received notification today that Diane Chirka, a valued member of
the community, passed away.
COUNCIL REPORTS: None
ADJOURNMENT
There being no further business, the meeting was adjourned at 10:41 p.m. The Council extended a
tribute to our nation's men and women serving in the military. We wish to honor the memories of those
who have died in past wars in defense of our country, including those who have died in the current
conflicts in Iraq and Afghanistan.
Respectfully submitted,
1 .
- a J )r
Kren iaz
City CIeYk
City Council Minutes Page 13 of 13 April 17,2012
