ATTACHMENT 1 <br /> RESOLUTION NO. <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> APPROVING THE AGREEMENT FOR IMPLEMENTATION OF THE ALAMEDA <br /> COUNTYWIDE CLEAN WATER PROGRAM <br /> WHEREAS, 1987 Amendments to Clean Water Act made necessary the adoption of <br /> plans and programs by Municipal Separate Sewer System agencies for storm water <br /> management meeting certain storm water runoff discharge criteria; and <br /> WHEREAS, In 1991 a consortium of 17 agencies in Alameda County including 14 cities, <br /> Alameda County, Alameda County Flood Control and Water Conservation District, and Zone 7 <br /> of the District determined that the most cost effective way to obtain coverage was to work <br /> together through a countywide storm water program (Program) as one group ;and <br /> WHEREAS, the 17 agencies (including the City of Pleasanton) in Alameda County <br /> entered into a Memorandum of Agreement (MOA) to implement the Alameda County Urban <br /> Runoff Clean Water Program dated July 1991; and <br /> WHEREAS, the 1991 agreement provides that the agreement may be amended from <br /> time to time by written agreement of the parties' governing bodies representing two-thirds or <br /> more of all allocated votes; and <br /> WHEREAS, On October 14, 2009 Regional Water Quality Control Board reissued the <br /> storm water NPDES permit as a permit covering the 17 agencies as well as 56 other storm <br /> water dischargers throughout the San Francisco Bay Region, the new permit is referred to as <br /> the Municipal Regional Permit or MRP; and <br /> WHEREAS, The new MRP permit added more requirements than the previous permit <br /> which would require more time and cost for compliance; and <br /> WHEREAS, A workgroup from the Program's Management Committee reviewed the <br /> MOA and is recommending that each party to the MOA approve an Agreement Providing for <br /> Implementation of the Alameda Countywide Clean Water Program. <br /> NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> SECTION 1. Approves the Agreement Providing for Implementation of the Alameda <br /> Countywide Clean Water Program and authorizes the City Manager to sign the agreement when <br /> approved as to final form by the City Attorney. <br /> SECTION 2.. This resolution shall become effective immediately upon its adoption. <br /> PASSED, APPROVED, AND ADOPTED by the City Council of the City of Pleasanton at <br /> a regular meeting held on May 15, 2012. <br /> I, Karen Diaz, City Clerk of the City of Pleasanton, California, certify that the foregoing <br /> resolution was adopted by the City Council at a regular meeting held on the 15th day of May <br /> 2012, by the following vote: <br />
